Dear Mr. Putney:

I am responding to your Petition of March 28, 1996, that you submitted to the

U.S. Nuclear Regulatory Commission (NRC) on behalf of Barry L. Bennett (the

Petitioner) pursuant to Section 2.206 of Title 10 of the Code p_f Federal

Reaulationi (10 CFR 2.206).

In the Petition, you alleged security

deficiencies at Crystal River Nuclear Generating Plant, Unit 3 (CR3).

You

requested the NRC to investigate the Petitioner's concerns and, upon a

determination that his concerns are valid, to institute a proceeding to

suspend or revoke the operating license of CR3 pursuant to 10 CFR 2.202 until

such time as these concerns are addressed.

We acknowledged receipt of your

Petition in a letter dated April 24, 1996, and informed you that as provided

by 10 CFR 2.206, action will be taken on your request within a reasonable

time.

The NRC staff has completed its review of the issues and has reached

final conclusions, which are discussed in the enclosed Director's Decision.

Because the inspection report referenced in the Director's Decision contains

Safeguards Information, only the letter, Notice of Violation anc. the

inspection report summary are enclosed.

For reasons discussed in the Director's Decision, the staff concludes that

operation of the CR3 facility does not endanger public health and safety.

Therefore, any further action on the issues you have raised in your Petition

is denied.

As required by 10 CFR 2.206(c), a copy of this Director's Decision will be

filed with the Secretary of the Commission for the Commission's review.

the Federal Register for publication.
