SUBJECT:

YOUR LETTER OF SEPTEMBER 27, 1984 TO MR. GOGOL OF CANP I am enclosing a copy of Mr. James Carp's letter to me of May 16, 1985 and my reply to his letter.

10 CFR requires that computer assisted nuclear safety related calculations be performed using the duly validated computer programs and that the computer program name and the developer's name be clearly identified when such calculations are presented.

Your Exhibits 10-13 to the letter to Mr. Gogol identify the developer as Volumetrics, a company of California.

However, as can be seen from his letter, Mr. Carp questions your statement.

If he is correct, you owe an apology to both Mr. Carp and to Mr.

Gogol for sending incomplete information. I, personally, feel intendtofullysatisfyMr.Carpuponthereceiptf embarassed, and I of your information on the developer's name if it turns out to be other than stated in your letter to Mr. Gogol.

Your letter refers in several instances to the Volunetrics sof tware relative to the Zion Irak test.

Volumetrics has never furnished software to Zion or in fact to any Carrnonwealth Edison facility.

We find your ranarks libelous and slanderous, and demand a public apology, and a written withdrawal to the NRC absolving our canpany.

We look forward to a quick solution to save us both the time and effort of litigation.

YOUR LETTER TO ME OF MAY 16, 1985 This is to acknowledge the receipt of your letter to me of May 16, 1985. Your desire to disassociate your company from the computer program used for Zion leak rate tests is understandable in view of errors or fraudulent options in this program.

Ho' wever, the NRC materials sent by Mr. Denton to Mr. Gogol of Chicago CANP on September 27, 1984, identify your company as the author of the computer program used in the Zion leak rate test. I am enclosing a photocopy of the relevant part of materials (Exh. A).

Notwithstanding, I wrote Mr. Denton today (I am enclosing a copy as Exh. B) asking him to provide information on the subject. Should you wish to express your fqelings to Mr. Denton directly I would encourage you to do so.

Upon receipt of Mr. Denton's answer in your favor I will immediately: 1) bring you my apologies in writing; 2) publicly denounce my accusation; and 3) write a withdrawal to the NRC absolving,your company. Believe me, I know how unjustified and incorrect statements may hurt.

As to your implicit threat of bringing a libel suit I may only suggest that you feel free to do so. Whether you really have authored the faulty and illegal computer program as the NRC suggests or not, the wrong and sometimes fraudulent practicies of the current leak rate testing deserve an exposure, and they are quite likely to be a subject of a judicial review unless the situation improves drastically.

If, as you say, the NRC identification of your company as the developer of the programs is not correct, it certainly would be a pity to incur a financial damage to an innocent party. I am glad that such is not the case since I referred the matter only to the NRC, that is to the same party that had supplied me with the information which, you say, is incorrect. I have not identified your company as the author of a faulty computer program with any other than NRC party that, possibly, has, may have or might have had any relation with your company and, therefore, your reputation has not, and could not have been damaged in any way.

It is most fortunate that I received your letter today. I am planning to speak before the NRC on June 4, 1985. Should I receive Mr. Denton's clarification abao viCITH 29M. 2[ou authorship before this date

Otherwise, I will limit myself with what my attorney recommended me to do, that is, with presenting both, the Volumetrics and the NRC sides of the story.

The software used in these tests was developed by onsite personnel.

The Volumetrics Corporation provided none of this material.

Zion Station utilizes Volumetrics equipment for containment data acquisition.
