R. 2608 (enclosure 1). Members present included Chaiman Udall ~ (D-Arz.) and Representatives Weaver (D-Ore.), Syms (R-Idaho), Cheney (R-Wyo.), Vento (D-Minn.), Carr (D-Mich), Marriott (R-Utah), Sharp (D-Ind.), Evans (R-V.I.), Bereuter (R-Neb.), Mathis (D-Ga.), Kostmayer (D-Pa.), Corrada (D-P.R.), Murphy (D-Pa.),

Edwards (R-0ka. ), Markey (D-Mass. ), Lujan (R-N.M. ), Marlenee (R-Mont'.)

Rahall (D-W.V.) and Binghati (D-N.Y.).

Chaiman Udall opened the session by indicating that the Subcommittee staff would soon have a. schedule for the Subcomittee's inquiry into the role of nuclear power in the United States. Mr. Udall indicated that the incident at Three Mile Island would be the starting point.for the inquiry. Mr. Udall also proposed that the Subcomittee visit the NFS facility at West Valley, N.Y. on May 4,1979, and return to Washington via Harrisburg, Pa.

Proposed NRC amendments tp 8.R. '2608 for the presence requirement, statutory recognition of the Office of Inspection and Enforcement, and on safeguards information were passed.

The Subcor.raittee rejected the NRC's proposal for increasing civil penalties, accepting an alternate proposal offered by Rep. Kostmayer (enclosure 2).

The Subcomittee added the following amendments:

An amendment offered by Rep. Bingham that $60,000 should be available for the employment of two individuals to N

be assigned for implementation of the US-IAEA Safeguards treaty following its ratification (enclosure 3).

lirr t!eaver offered an amendment (enclosure 8) that no monies be expended by the liRC for licensing the construction or operation of nuclear power plants until the Comittee notifies the Commission that it has completed an investigation of the nuclear safety issues and Congress by resolution, has approved the expediture. The Subcomittee adjourned acting on the amendment.

The Subcommittee' plans to meet at 9:45 a.m. Tuesday, May 1,1979, in itoom-2257 of the Rayburn House Office Building to continue mark-up.

Moneys received by the Commission for the co-6 operative nuclear research programs may be retained and 7 used for salaries and expenses associated with those pro-8 grams, notwithstanding the provisions of section 3617 of the 9 Revised Statutes (31 U.S.C. 484), and shall remain available 3

, The Conmittee on Foreign Affairs has completed its review of the proposed Nuclear Regulatory Commission Bud t for fiscal year 1980. l.'e have . paid particular attenti'cn this year to '(1)gethe proposed increase _of funds for

the Office of International Programs (OIP), and (2) recent reorganization-efforts within the Office of Nuclear Materials Safety and Safeguards (NMSS).

'Together, these offices have. major new responsibilities pursuant to the Nuclear b._ Nonproliferation - Act of 1978 to upgrade ' international safeguards, strengthen the. export and import. licensing process', and _ explore further international cooperation in'the area o.f nuclear health and safety. The Committee notes that the proposed fiscal year 1980 budget increase of 5244,000 for four additional OIP'professionais is ccTmensurate with the . increase in the ' number and intensity of export license reviews, and with the: .ne:d.for greater NRC participation in the renegotiation of agreements for cooperation and the consideration of. foreign retransfer and reprocessing reo'uests. One of the four reauested professionals will also assist in efforts relating 1to outstanding international health and safety matters, and implementation of the-. President's recent Executive Order on international environmental controls. It is interesting to observe that even with this increase, the OIP consumes 'less than ene _ percent of the Comission's total funds, while international . nuclear policy issues clearly make up more than a third of the Comission's ~ workload. Based on its review of recent efforts to upgrade the international safeguards office within' NMSS, the Committee cri Foreign Affairs rectnended in its March 15 budcat resolution a S60,000 funding increase in fiscai year 1930. Suecificall.y, the orcoosed increase would provide for 'an additional two cers:nnel to impierent the voluntary submission agree:en. concluded between tne U.S. and the IAEA. and now pending Senate ratification.
