Dear Mr. Graber:

This is in further response to your letter dated December 14, 1984, in which you requested, pursuant to the Freedom of Infonnation Act (F0IA), that NRC place in the Public Document Room (PDR) all NRC internal memoranda to Division of Licensing on Beaver Valley Unit 2 from May through November 1984 which provided draft SER, SER sections, and NRC ouestions or requests for additional information for transmittal to Division of Licensing.

The enclosed Appendix B identifies a document which is being made available for your inspection and copying at the PDR.

Portions of enclosure 2 contain unclassified safeguards information. The statutory authority for withholding this information is found in Section 147 of the Atomic Energy Act (42 U.S.C. 2167). This information is being withheld from public disclosure pursuant to exemption (3) of the F0IA (5 U.S.C. 552(b)(3)) and 10 CFR 9.5(a)(3) of the Commission's regulations.

Pursuant to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. John G. Davis, Director, Office of Nuclear Material Safety and Safeguards.

This letter may be appealed to the NRC within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

The staff is continuing to search for additional records subject to your request. We will notify you upon completion of the search.
