Dear Mr. Rutherford:

In an August 13, 1996, letter from the Nuclear Regulatory Commission to you, we informed you that we were prepared to approve your request to terminate i Special Nuclear Material license SNM-21 governing the Building 020 Hot Lab at the Santa Susana Field Laboratory. From information provided in your letter of August 23, 1996, to NRC, we conclude that the remaining decommissioning work at the Hot Lab will be accomplished in compliance with U.S. Department of j Energy (DOE) health and safety regulations, and with no undue risk to the public health and safety.

! In your August 23, 1996, letter to NRC, you state that:

"[S)ince late 1995, the DOE and Rockwell have been cooperating on an i accelerated cleanup schedule for the Hot Lab. . . . Soil sampling / surveys i will... be performed and completed by Rocketdyne and ORISE by the end of i

FY1997. Both the DOE and Rockwell are committed to completing the building demolition and decommissioning and final release of the l remaining land."

Dear Mr. Rutherford:

In an August 13, 1996, letter from the Nuclear Regulatory Commission to you, we informed you that we were prepared to approve your request to terminate l Special Nuclear Material license SNM-21 governing the Building 020 Hot Lab at the Santa Susana Field Laboratory. From information provided in your letter J of August 23, 1996, to NRC, we conclude that the remaining decommissioning {

work at the Hot Lab will be accomplished in compliance with U.S. Department of l Energy (DOE) health and safety regulations, and with no undue risk to the public health and safety.

In your August 23, 1996, letter to NRC, you state that:

"[S]ince late 1995, the DOE and Rockwell have been cooperating on an accelerated cleanup schedule for the Hot Lab. ... Soil sampling / surveys will... be performed and completed by Rocketdyne and ORISE by the end of FY1997. Both the DOE and Rockwell are committed to completing the building demolition and decommissioning and final release of the remaining land."

These comments respond to our concern that Rockwell not terminate performance of decontamination, decommissioning, and demolition work, prior to completion, as allowed under the provisions of its contract with 00E. Accordingly, this letter serves to exempt Rockwell from the requirement of an NRC license at the Building 020 facility under the provisions of 10 CFR 70.11, and terminates Special Nuclear Material license SNM-21.
