I a l responding to your letter dated November 2,1992, concerning a " Demand for Payment" you received from NRC's cebt collection contractor for Invoice AM07121-91 for Quality Assurance Program Approval No. 0349.
As an enclosure to your November 2,1992, letter, you pro. ided a copy of your Radioactive Material License issued by the State of Illinois and stated that your understanding was, and is, that only state licensing is required for these devices. You further stated that you did not respond to the August 9, 1991, September 10, 1991, and October 8, 1991, invoices because each stated that non-payment may result in revocation of your license and this is what you were trying to do.
Invoice AM07121-91 is for the annual fee which has been established. based on Public Law 101-508 passed by Congress on November 5, 1990.
Notices of the proposed and final revisions to the Commission's fee regulations,10 CFR Part 170 and 10 CFR Part 171, were mailed to.all MRC licensees on' April 5,1991, and July 8, 1991, respectively.
In accordance with the revisions to 10 CFR Part 170 and 10 CFR Part 171, holders of materials licenses and approvals are subject to application, renewal, amendment, inspection and annual fees.
The final rule revising 10 CFR Part 170 and 10 CFR Part 171 provided an opportunity for licensees who wished to relinquish their licenses and who were capable of permanently ceasing lictnsed operations by September 30, 1991, to avoid the FY 1991 annual fee if the licensee notified the Commission in writing within the 30-day period prior to the effective date of the rule (56 FR 31475 and 31485; July 10, 1991). As stated in the Federal Register notice, and the notice which was mailed with the invoice, the effective date of the rule was August 9, 1991.
Our records show that Mr. G.L. Kramer of Caterpillar wrote to NRC concerning the invoice on August 8,1991, indicating that he understood all licenses had been replaced by the license issued by the State of Illinois.
On September 27, 1991, Mr. Kramer faxed a request to the licensing staff to terminate the QA approval.
