4 NOV 2 71992 Mr. Edward LaBrenz, President Amalgamated Local Union No. 515 International Union United Plant Guard Workers of America P. O. Box 334 Buchanan, New York 10511

Dear Mr. LaBrenz:

Your October 28,1992, letter to the Chairman of the U.S. Nuclear Regulatory Commission (NRC) was referred to this office for response. Your letter requested NRC assistance with regard to an August 20,1992 occurrence at Consolidated Edison Company's Indian Point facility that you characterized as both disturbing and potentially dangerous to security personnel at the plant. The occurrence involved the discovery of obstructions that apparently had been placed intentionally in the barrels of two contingency response weapons. You indicated that Consolidated Edison Company (the licensee) had undertaken an investigation to determine the identity of the person or persons responsible, but the outcome of the investigation had not been discussed with security personnel and they were apprehensive about additional threats (to their safety) that may be made.

We share your concern over this matter, it was brought to the attention of the NRC Resident inspectors by the licensee shortly after it was uncovered and it was reported to the NRC in accordance with applicable regulations. After receiving your letter, a member of my staff contacted the licensee to inquire into the status of their investigation. The licensee indicated that they would have the guard force contractor management discuss the current investigation status with contractor union management.

We were advised that the investigation is not complete. Numerous interviews with security _

personnel have been conducted and other investigative techniques have been pursued. -_The licensee indicated that the investigation will remain open until the identity of the individual (s) is determined or, if that is not successful, at least until all security personnel have been indoctrinated during their annual requalification training cycle as to the potential serious consequences of such an act. Thus far, the licensee believes that the obstructions were placed -

by a member of the security organization, because only security personnel had access to the weapons. Additionally, the licensee believes that it was a prank, with no malicious intent, because of the nature of the obstructions. We were also advised that, while a formal announcement regarding the status of the investigation had not been made, security personnel are aware that those responsible have not been identified and that the matter is being addressed in training sessions and during visits to security posts by supervisors.

NOV 2 71992 Mr. Edward LaBrenz 2 We believe that the licensee has responded and continues to respond to this matter in a responsible manner. If you believe, as you suggest in your letter, that an investigation by others has merit, you should discuss that directly witn the licensee.

I trust this letter is helpful in alleviating your concerns. We appreciate your interest in our programs.

Sincerely, 0?;-:'F! S!;ned Cy:
