Dear Mr. LaBrenz:
Your October 28,1992, lettr to the Chairman of die U.S. Nuclear Regulatcry Commission (NRC) was referred to this office for response. Your letter requested NRC assistance with regard to an August 20,1992 occurrence at Consolidated Edison Coinpany's Indian Point facility that you characterized as both disturbing and potentially dangerous to security personnel at the plant. The occurrence involved the discovery of obstructions that apparently had been placed intentionally in the barrels of two contingency response weapons. You indicated that Consolidated Edison Company (the licensee) had undertaken an investigation to determine the identity of the person or persons responsible, but the outcome of the investigation had not been discussed with security personnel and they were apprehensive about additional threats (to their safety) that may be m*.de.
We share your concern over this matter. It was brought to the attention of the NRC Resident Inspectors by the licensee shortly after it was uncovered and it was reported to the NRC in accordance with applicable regulations. After receiving your letter, a men,ber of my staff ccatacted the licensee to inquire into the status of their investigation. The licensee indicated that they would have the guard force contractor management discuss the current investigation status with contractor union management.
We were advised that the investigation is not complete. Numerous interviews with security personnel have been conducted and other investigative techniques have been pursued. The licensee indicated that the investigation will remain open until the identity of the individ"al(s) is detenniner -, if that is not successful, at least rntil all security personnel have been indoctrinate : 4 ring their annual requalification t..aning cycle as to the potential serious consequeno. of such an act. Thus far, the licensee believes that the obstructions were placed by a member of the security organization, because only security personnel had access to the weapons. Additionally, the licensee believes that it was a prank, with no malicious intent, because of the nature of the obstructions. We were also advised that, while a formal announcemeit regarding the status of the investigation had not been made, security personnel are aware that those responsible have not beca identified and that the matter is being addressed in training sessions and during visits to security posts by supervisors.
