Items of Interest Week Ending November 27, 1992 Seabrook A meeting was held on November 23, 1992, with the licensee to discuss progress '

on the transfer of responsibility for offsite emergency planning from the licensee to the Commonwealth of Massachusetts. The licensee stated that all actions are on schedule for a transfer by December 31, and provided a letter from HEMA (Massachusetts Emergency Management Agency) to FEMA, dated November 19, 1992, declaring that the State is ready to assume responsibility.

FEMA had previously informed both the licensee and staff that they will complete their evaluation by December 11 and forward it to the NRC staff. The licensee will accomplish transfer pursuant to 10 CFR-50.54(q), which requires no formal action by the NRC staff.

Troian Nuclear Plant On November 23, 1992, the Union of Concerned Scientists (UCS) requested that -

the Commission take a number of actions based on staff concerns regarding potential multiple tube ruptures resulting from use of interim plugging criteria for steam generator tube repair (bobbin-based voltage criteria). As a basis for their concerns, UCS cites the Office of Research's (RES) memorandum dated September 28, 1992, which contains RES's prioritization evaluation for Generic Issue (GI) 163. In part, UCS's letter requests that .

the Commission direct the staff to explain why all plants with approved interim plugging criteria amendments should not be shut down until GI-163 is resolved. This includes Trojan Nuclear Plant and other facilities. The staff is currently evaluating actions to be taken in response to the UCS letter.

Meetina With NUMARC on Procurement and Commercial Grade Dedication On November 13, 1992, the Director and Deputy Director of the Division of Reactor Inspection and Licensee Performance, and several members of the Vendor Inspection Branch met with Nuclear Management Resources Council (NUMARC) representatives to determine the key procurement and commercial grade dedication issues where the NRC and NUMARC are still in disagreement. The NRC-identified several issues where differences are evident and these were discussed with NUMARC. Both the NRC and NUMARC agreed to identify and document the key dedication issues where disagreements exist and document-their position on each. These issues will be discussed at the next meeting with NUMARC scheduled for December 10, 1992. The NRC will'also be holding meetings with individual utilities to discuss specific commercial grade-dedication findings identified during.the-pilot inspections at their facilities. The first meeting is scheduled with Florida Power Corporation to discuss the inspection results from the pilot inspection conducted at Crystal River, Unit 3 in March 1992.

effort to reexamine nuclear power plant security requirements associated with the' internal _ threat. As a general opening remark,-NUMARC representatives stated that one of their major ongoing activities was -identification of' -

regulatory requirements that'they considered burdensome and appropriate-for

' reduction or elimination. They stated-that security was a prime area where.

reductions were appropriate. .Each of the staff's recommendations contained =in SECY-92-272, "Re-Examination of NPP Security Requirements Associated With the Internal Threat", was discussed in-relation to the associated: position in =

NUMARC's APS. -

t NUMARC agreed to evaluate the alternative approaches that were discussed' and; indicated their plan to re-convene the NUMARC Ad Hoc Advisory Committee on protective measure requirements, The results of their' evaluation would' be -

provided to the NRC and be-the subject of a future aublic meeting. Staff ~

agreed to keep NUMARC informed of the progress of t1eir _reconsiderationiof the' a recommendations in SECY-92-272 and NUMARC's APS, and to arrange for future meetings to discuss the status of both-NUMARC's and staff's efforts.

Office of Nuclear Material Safety and Safeguards Items of--Interest Week Ending November 27, 1992 hoanese Deleaation Visits Diablo Canyon Power Reactor On November 20, 1992, a site tour of the Diablo Canyon Nuclear Power Reactor was provided for a Japanese delegation representing the Japanese Nuclear Material Control Center, Atomic Energy Research Institute, the National Police Agency and the nuclear industry. The delegation was accompanied by a Nuclear Material Safety and Safeguards staff member and representatives of the Departnent of Energy and Sandia National Laboratories. The host utility, Pacific Gas and Electric Company, provided overview briefings on the physical protection requirements and system and a tour of selected areas of the site.

tieetina on Monitored Retrievable Storace On November 20, 1992, representatives of the Offices of Nuclear Material Safety and Safeguards and Nuclear Regulatory Research and the Department of Energy (D0E) discussed safeguards requirements that are expected to be applicable to the monitored retrievable storage (MRS) site. The physical security being planned by DOE appears to exceed the Nuclear Regulatory Commission staff's current position. DOE indicated that they may request NRC to expedite the currently planned rulemaking which would define the safeguards requirements that would be applicable.

t!petina With Babcock & Wilcox Reaardino Model No. UNC-2600 On November 18, 1992, the Transportation Branch staff met with representatives from Babcock & Wilcox Company (B&W) to discuss reinstatement of Certificate of Compliance No. 5086, Model No. UNC-2600 package. The Nuclear Regulatory Commission had previously agreed to reinstate the certificate under the condition that B&W shows that the package meets the requirements of 10 CFR Part 71 for a Type B(U)F package. The staff and B&W discussed the packaging modifications and analyses that B&W would have to perform to show that the package meets Type B(U)F requirements. B&W expects to submit an application by May 30, 1993.

Meetina with Westinahouse Recardino Model No. MCC-4 Modifications On November 19, 1992, the Transportation Branch staff met with a Westinghouse Electric Corporation representative to discuss modifications to the Model No.

MCC-4 shipping container.- The MCC-4 shipping container is designed to transport standard PWR fuel assemblies. Westinghouse plans to modify the container to carry-hexagonal cross-sectioned, PWR fuel assemblies (designated as Temelin fuel assemblies). Westinghouse believes that the loads and reactivity of the Temelin fuel assemblies are bounded by previously approved l contents. Westinghouse expects to submit an application in' March or April

Midwestern Hiah-Level Radioactive Waste Transoortation Committee Meetino 5 On November 20, 1992 Transportation Branch staff participated in a meeting of  :

Columbus, Ohio. - Members of the Department of Energy (DOE) also participated.-

The meeting focused on DOE's shipping cask development for the high-level waste repository. An overview of the Nuciear Regulatory Commission's .,

Transportation Program was provided, llpdate of Pawlina Site. Decommissionina Plan (SDMP)

On November 13, 1992,_ Chevron Corporation signed a Cooperative Agreement with the National Park Service for the cleanup of the Pawling,- New York, SDMP site.

. Chevron indicated that they wished to negotiate a Confirmatory Order with the-Nuclear Regulatory Commission. . Chevron also desires to pursue' cleanup of the contaminated soils at the site prior to December 31, 1992, in order to avoid-higher disposal costs that will go into-effect after this d6te at the Barnwell disposal site. "

The National Park Service began an underwater search for radioactive waste in 4 Nuclear Lake that is adjacent to the Pawling site ground penetrating radar investigations identified (previous magnetic S0 to 60 cbjects and' atlthe bottom of the lake). WhiletheinvestigationisstiTlcontinuing, objects have been identified by SCUBA divers as tree stumps,- pk tic bags with stones,-

and a Jeep. Surveys performed on the identified objects indicated .the o presence of-no radioactive material.

Undate on Northeast Ohio Reaional Sewer District / Southerly P1&nt(NE0RSD/SR Cuyahoaa Heiahts. Ohio During an overflight.of the area surrounding!the Chemetron site-in Cleveland; Ohio,.Co-60 contamination was discovered at the NE0RSD/SP site. Co-60 apparently entered the sewerage _ system 10 to 12 yuars ago from an unknown h source,-and was processed by the plant.

-A meeting was held on November 10, 1992, in Rockville, Maryla'nd, between

-NE0RSD/SP representatives and Nuclear. Regulatory Commission-staff..-

Discussions were on remediation and lagoon cleaning, a worker: exposure analysis,' cost recovery options, and- future maintenan_ce-activities on~ the East-Ohio Gas-Pipeline.that runscadjacent to one of_ the contaminateo areas. While NE0RSD/SP is in the process of preparing a schedule for remediation and ' lagoon cleaning, they expressed concern that the NRC's regulatory program did not-

. prevent the contamination of their_ facility from reoccurring.:-They also  ;

indicated that they would attempt to recover costs associated with the- s g . management of the radioactive material.

The purpose of the meeting was to obtain early input from interested individuals on the issues to be addressed in a guidance document on the storage of mixed radioactive and hazardous waste. The meeting was attended by approximately 100 individuals representing industrial, academic', medical, utility, and environmental groups and government organizations. Participants discussed numerous issues involving mixed waste storage including: the impact of dual regulation on the industrial, medical, and research communities, the need to quickly develop guidance that promotes the use of the flexibility in the existing regulations to address practical issues of mixed waste management, the need to establish de minimis levels for radioactive and hazardous materials and th importance -

cf using discretion in enforcing its storage prohibition regulations.

ESCEA Provides NRC/ EPA With Position Paper on Mixed Waste A letter dated November 9,1992, from the U.S. Council for Energy Awareness, Committee on Radioactive and Radiopharmaceutical (USCEA/CORAR) provided the Nuclear Regulatory Commission and the Environmental Protection Agency (EPA) with a paper outlining the USCEA/CORAR's position on mixed waste. The paper emphasizes USCEA/CORAR's concern with the lack of progress in treatment and disposal options for mixed waste, provides a briof overview of mixed waste generation and management in the biomedical community and outlines USCEA/CORAR's perceptions of the issues cau.ing the lack of progress in developing treatment and disposal capacity. The paper recommends a number of specific actions including: clarifying when a material becomes waste (to allow for recycling), ootaining better data on mixed waste volumes and characteristics, the establishment of de minfafs levels for radioactive and hazardous waste constituents, the elimination of dual regulatory requirements, development of a Federal treatment and dispusal site at a Department of Energy facility and encouraging waste minimization. Publig_Peetina Held in Plt [ny_i)1e. Massachusetts Concernino the Enaelhard Site A public meeting was held November 10, 1992, concerning the Engelhard Corpcration site in Plainville, Massachusetts. The meeting was sponsored by Region 1 of the U.S. Environmental Protection Agency (EPA) and the Massachusetts Department of Environmental Protection (DEP). The Engelhard site is listed on, and described in, the bite Decommissioning Management Plan (SECY-92-200). The purpose of the meeting was to introduce, to the public, a_

draft of the Public Involvement Plan (PIP), that will be issued by DEP, and to l answer questions from the public. The PIP describes the process and roles of l

each regulatory agancy in the clean-up of the site, it also addresses the process by which the public can stay informed about site activities and comment on documents produced.

Hi_cAlgg A meeting was held November 9,1992, between Nuclear Regulatory Commission staff and officials and contractors of Waste Management of North America (WMNA) and State of Michigan in Bay City, Michigan. The Hartley and Hartley Landfill site is listed on, and described in, the Site Decommissioning Management Plan (SECY-92-200). The site is unlicensed and contaminated with magnesium / thorium alloy wastes and hazardous waste. WMNA described their plans for characterizing and remediating the site. They plan to use the service license of Chem-Nuclear, Inc., a sister company to WMNA, to do the characterization and remediation. Before the characterization is complete,

, WMA plans to apply for a license to possess the thnrium material and to process ground water to remove hazardous chemicals.

Part 72 Licept Issued to Saltimore Gu and Electric ,_Calvert_. Cliffs On November 25, 1992, the staff issued a Part 72 spent fuel storage license to '

the Baltimore Gas & Electric Company for the Calvert Cliffs Station. The dry-storage technology chosen is the NUHOMS-24P horizontal storage module. The license term is for 20 years.

IIRG/00E Interactions Schedulino Meetino On November 24,1992, staff from the Division of High-level Waste Management (HLWM) and the Department of Energy (DOE) conducted a scheduling meeting at 00E Headquarters. The purpose of the meeting was to establish a schedule of interactions between Nuclear Regulatory Commission and DOE staff for the January through June 1993 time frame. The topics of the scheduled interactions that were agreed upon by NRC, DOE, and the State of Nevada are:

NRC's observation of DOE's Waste Isolation Pliot Project cound table discussion; DOE's approach to resolving volcanism-related study plan and site characterization concerns; DOE's approach to the integration of geophysical activities with other site characterization activities; DOE's use of topical reports; DOE's presentation and site visit of on-going activities at Yucca Mountain (e.g., Quaternary faulting within the siteJarea, and the Exploratory Studies facility); DOE's overview of its program planning and integration processes; and DOE's treatment of NRC rcquirements contained in 10 CFR Parts -

60, 71, and 72. A subsequent interactions scheduling meeting is scheduled for June 10, 1993.

Expert Judament in Hiah-level Waste '

Division of High-level Waste Management-staff attended workshops in Paris, France, (October 7-9) and Albuquerque, New Mexico,-(November 18-20) where potential use of expert judgment for repository licensing was discussed. Both workshops had similar formats -- tutorial ' presentations by decision analysts and " case history" discussions of experiences with expert judgment by waste managers. Neither workshop seemed to reach any substantive conclusions regarding appropriate uses of expert judgment in nuclear waste disposal NOVEMBER 27, 1992 ENCLOSURE B

programs. At the Paris workshop, it was clear that the more formal uses of l expert judgment are under active consideration only in the U.S. and Great l Britain. Plans for using expert judgment in Europe and Canada involve l relatively informal methods. Discussions with the Nuclear Regu'latory i Commission's Office of the General Counsel in pre)aration for the workshops indicate that the NRC's licensing process seems a)1e to acconynodate virtually any responsible type of expert judgment, from the forntal elici*ation of an expert panel to the informal, extemporaneous views of a single eroert. l l  !

1. A Notice of Violation and Proposed Imaosition of Civil Penalty in the amount of $62,500 was issued on Novemaer 25, 1992 to Philadelphia ,

Electric Company, (Limerick Unit 1). This is action was based on an event at Limerick involving unplanned radiation exposure to plant personnel working in the Unit I drywell during low power operation.

This occurred as a result of the presence of a previously unidentified, intense beam of radiation in a portion of the work area. Because there was a substantial potential for exposure in excess of Part 20 limits, the violations associated with this event were categorized in the aggregate at Severity Level 111. (EN 92-088)

2. A Notice of V'olation and Prososed imposition of Civil Penalty la the amount of $125 was issued on l40vember 30, 1992, to Soil Consultants, Inc., St. peters, Missouri. This action is based on an incident in which a moisture density gauge was run over by a vehicle after the gauge was left unattended at a temporary job site. The gauge user had set the gauge at the rear of his vehicle and then moved to the driver's side door where he engaged in a conversation with a construction foreman.

After becoming distracted by the conversation, the user entered the vehicle to drive away, lie did not realize that he had left the gauge behind the vehicle until he drove over it and caused damage to the case.

Office of State Programs Items of Interest Week Ending November 27, 1992 CAL RAD forum Meetina Dean Kunihiro, Region V State liaison Officer, attended the California Radioactive Materials Managrwnt (CAL RAD) forum Fall Conference on November 22-23, 1992 in San Diego, California. This year's conference was entitled: " Low-level Radioactive Waste Disposal in California: Political, Technical and Legal Update." Among the more noteworthy presentations was the forum Chairman's (Donna Early) presentation on the negative impacts that lack of LLW disposal options would have on the Cedars-Sinai Medical Center.

Because of limited space, on-site storage would not be possible, and medical uses, including research, of radioactive materials would essentially cease.

1. Massachusetts General Hosoital, License No. 20-03814-80 During the week of 11/16-20/92, a team of four health physicists from Region 1 performed an inspection at the Massachusetts General Hospital (MGH) in Boston, Mass. The Chief of the Medical Inspection Section from Region 1 joined the team on 11/19/92, for a tour of the facilities and, along with the inspection team, attended the exit meeting with the Chairman of the Radiation Safety Committee, Director of Safety, Assistant General Director of Safety and Regulation, and other members of the MGH staff.

MGH has a broad scope license and has programs in teletherapy, brachytheraay, nuclear medicine, and research. The inspection team concluded t1at there were no violations of NRC regulations and that the radiation safety program appeared to be well run by a knowledgeable staff.

2. Limerick Generatina Station. Emeraency Exercise On 11/24/92, from 8:00 a.m. until 2:00 p.m., a parital-participation emergency exercise was conducted at the Limerick Generating Station. The exercise began with a simulated casualty and escalated to a General Emergency due to entry of toxic gas into the power block, followed by loss of all annunciators during a plant transient, then a Loss of Coolant Accident (LOCA) with fuel clad failure, resulting in high drywell radiation levels. There was a simulated stack release of radioactive material. Preliminary assessment was that licensee actions were adequate to protect public health and safety. The Commonwealth of Pennsylvania participated by providing representatives to the Emergency Operations facility. Off-site activities were not observed.

1. Carolina Power and Liaht Comoany On November 23, representatives from the Carolina Power and Light Company were in the Region !! Office for an Enforcement Conference related to an inadvertent drain down and loss of shutdown cooling at Brunswick. NRC concerns from this event involve apparent inadequate command, control and communications by the operations staff and

< inadequate management and programmatic controls of the method for primary system shutdown cooling.

2. Duke Power Company On November 24, Duke Power Company was in the Region 11 Office to attend .'

an Open enforcement conference regarding their Oconee site concerning the circumstances associated with the mispositioned valve in the Unit 3 low pressure service water system which resulted in the system being operated in a degraded mode.

1. Callaway Nuclear Plant The Regional Administrator and staff met on i,'avember 24, 1992, with Donald Schnell, Vice President Nuclear, Union Electric Company, to conduct an enforcement conference. The purpose of the conference was to discuss the cause(s) and corrective actions for the licensee's failure I to properly identify the total loss of control room annunciators. In addition to the broader performance issues, the licensee's failure to make an " Alert" emergency classification and red phone notification to the NRC, as required by 10CFR50.54(g) and the Callaway Plant Radiological Emergency Response Plans and implementing procedures were also discussed.
2. Dresden Nuclear Plant >

On November 24, 1992, the Commonwealth Edison Company notified the NRC that a control rod mispositioning incident occurred on September 18, 1992. Licenses and NRC preliminary review indicates that the. incident had minimal impact on plant safety; however, the incident had not been documented in the operating log, entered into the licensee's corrective action system, or reported to senior licenseo management, as required.

The licensee has initiated an investigation of the incident.- Five individuals involved (a senior reactor operator, a reactor operator, and three engineers) have been suspended pending the results of the investigation. Senior licensee management became aware of the incident on November 24, after a discussion between one of the nuclear engineers.

and another' technical staff member on November 23. The licensee and NRC Region Ill have implemented augmented shift coverage. An investigation / inspection team will report to the site on November 30, 1992, for detailed review of the incident and the licensee's response.

3. Perry Nuclear Plant Effective December 17, 1992, Mr. Michael D. Lyster will resign as Vice President Nuclear-Perry. Mr. Lyster accepted a position with

, Commonwealth Edison Company as the Sito Vice President for the Dresden Nuclear Station. Mr. Robert A. Stratman was elected Vice President Nuclear-Perry by the Centerior Energy Board of Directors. The appointment is effective December 7,19" Mr. Stratman was the General Manager at the Perry Nuclear Power Plar. A new plant manager will be announced on December 18.

1. Doerational Safety Team Insnection at South Texas Prohti On November 30, 1992, an Operational Safety Team Inspection (OSil) began at the South Texas Project. The OSTI team consists of representativas from AE0D and Region IV. The inspection will be conducted November 30 '

through December 11, 1992, and will review how the difforent organizations support plant operations. The inspection is intended to verify operational safety activities and to provide the NRC a better understanding of licensee performance at South Texas Project.

2. Western Technoloales. Inc.. Enforcement Conference An enforcement conference will be held on December 1,1992, at the Region _IV office with Western Technologies Inc., to review the findings related to an inspection conducted at the licensee's temporary jobsite at the-White Sands Missile Range, New Mexico, on October 28, 1992. The conference will focus on the failure of licensee personnel to employ the use of alarm ratemeters during -

radiographic operations.

3. Future Tailinas Manacement for the Sweetwater Mill On December 1, 1992, the Director, URF0, and members of his staff will meet with representatives of Kennecott Uranium Company in the URF0 conference room to discuss future tailings management issues for the Sweetwater Hill, located in Sweetwater County, Wyoming. Among the issues will be whether to upgrade the existing disposal cell or to construct a new disposal cell.

2. On Povember 23, 1992, K. Perkins presented Operator Licensing Certificates to 6 Senior Reactor Operators and 9 Reactor Operators at San Onofre Nuclear Generating Station (SONGS) Unit 1. This was the final class of operators licensed for SONGS I prior to the unit's permanent shutdown.
