This is in reply to your letter of May 14, 19 69, requesting i

certain iniormstion.

l The Atomic Energy Act of 1954, as amended, requires tha t the Comunission hold a public hearing on each application for a nuclear power reactor construction permit. Fursuant to that l

requirement a public hearing on the applica tion by the Northers i

States Power Company for a construction permit for the Monticelle Nuclear Cteerating plant was held by an atomic safety and licens-ing board in Buf falo, Minnesota, on May 25-26, 19 67. The Act does not, however, require such a public bearing on applications l

for auc1aar power reactor operating licenses.

Af ter the Casaission's regulatory staff and the Advisory Cammittee on Reactor safeguards have completed their reviews of as applica-j tion to operate a nuclear power reacter and it is determined that i

the reactor can be operated without endangering the public beelth j

and safety, the Comunission publishes a antice in the Federal Resister of its inteet to issue an operating license to the applicant. The notice provides that unless a request for a j

public hearing is received within 30 days of the publication i

of the notice, the operating license will be issued, the notice also specifies the procedures for requesting such a public hear-ing and for the participation of the public in the public bearing.

i I an enclosing for your information a copy of such a notice which j

was recently issued by the Comunission.

With respect to the Monticello nuclear Generating Plant, Northera j.

States Feuer Campany's applicaties for sa operating license is l

presently under review by the Commission's regula tory staff and the Advisory Committee on Reactor gefeguards. I am not able at this time to estimate when that review will be completed er when a notice of the Commiission's intent to issue as operatias license will be issued.

The indepeadent committee which ausc review esch applicatien 4

j for a nuclear power reactor opera ting license to which 1 referred 2

is the Advisory Committee on Reactor Safeguards (ACRS). Section 29 of the Atomic Energy Act of 1954, as amended, establishes the ACR8 1

and provides thet it consise of a seximum of fif teen members ap-pointed by the Cosemission for terms of four years each. The i

function of the ACKS is, among other things, to review appiteations for nucinar power reactor licenses and to advise the Commission 4

with ressrd to the safety of reactor facilities. The ACES La j

composed of members with extensive emperience in the nuclear field.

Its members are selected from the ranka of Americas industry, re-i search and development laboratories and universities. I en enclos-ing biographical information on each of ths present members of the ACES.
