Operating License No. DPR-73 Docket No. 50-320 Licensing Fees Your letter dated May 3, 1985, requested that GPU Nuclear remit an, application fee of $150.00, for submittal of GPU Nuclear letter 4410-84-L-0187, dated October 31, 1984, entitled " Containment Isolation Valves".
The above referenced letter documented that certain TMI-2 containment penetration designs (i.e., described in TMI-2 FSAR Section 6.2.4) do not meet the modified Technical Specification definition of Containment Integrity issued by the NRC via the Amendment of Order dated July 17, 1984. Our letter also provided two tables which listed the affected containment penetrations. As discussed with members of the NRC staff, it is our understanding that these tables will be included in an upcoming Amendment of Order which will exclude these containment penetrations from the modified definition contained in the Technical Specifications.
Since we expect the issuance of an Amendment of Order to clarify a previous NRC order, issued in accordance with 10 CFR 2.204, an application fee is not required.
