Enclosed please find the Withdrawal of Petition to Intervene bythe West Valley Agricultural Protection Council, Inc.

which was delivered to us this morning by Mr. William T. Gladden, one of the West Valley officers.

Also enclosed is a copy of the Settlement Agreement referred to in the Withdrawal of Petition to Intervene.

The Settlement Agreement has been signed by West Valley and by APS as project manager and operating agent of Palo Verde Nuclear Generating Station.

Based upon the Settlement Agreement entered into with West Valley, and further based upon West Valley's withdrawal of its petition in this matter, APS respectfully requests that the Board enter an order dismissing the instant proceeding with prejudice and vacating the hearing now scheduled to commence on June 11, 1985.

APS is delivering the enclosed documents to the Board at the request of West Valley, O
