SUBJECT: NOTICE Of VIOLATION

(NRC INSPECTION rep 0RT NOS. 50-348/92-35 AND 50-364/92-35) .

This refers to the inspection conducted by G. f. Maxwell of this office on

December 8, 1992 through January 8, 1993. The inspection-included a review of

activities authorized for your farley facility. At the conclusion of the

inspection, and at various times during the inspection, the findings were

discussed with those members of your staff identified in the enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures +

and representative records, interviews with personnel, and observation of. 1

activities in progress.

Based on results of this inspection, certain aspects of your activities

appeared to be ir violation of NRC requirements as specified in the enclosed

"

Notice of Violation _(Notice). The violation is of concern because cite'

lubrication oils were procured " commercial grade" and-used in-safety related

applications without assuring their suitability for use in _the intended

safety-related applications. The Notice is being issued because your actions

to prevent recurrence have not been completed. We understand that your

evaluation will assure that other site materials are beir.g-handled in ~

accordance with appropriate controls to prevent inadvertent-use of

nonconforming commercial grade materials, in addition,Jthe enclosed

Inspection-Report identifies activities that violated NRC requirements that

will not be subject to enforcement action because the licensco's efforts in

identifying and/or correcting the violation meet the criteria specified in

Section Vll.B. of the Enforcement Policy.

You are required to respond to this letter and follow the instructions

specified in the enclosed ~ Notice when preparing your response. In your-

response, you should document the specific actions taken and any additional

actions you plan to prevent' recurrence and you should document specific  ;

completion dates for implementation of- permanent corrective actions. You

should-also address the generic and programmatic aspects of this. issue.

After reviewing your response to the Notice of Violation, including proposed

corrective actions and tie results of any future inspections, the NRC will

determine whether further NRC enforcement action is necessary to ensure

compliance with NRC regulatory requirements.

In accordance with Section 2.790 of the NRC's " Rules of Practice," a copy of

this letter and its enclosures will be placed in the NRC Public Document Room..

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paper Work Reduction Act of 1980, Pub. L. No. 96 511.
