NJTICE OF VIOLATION

(NW INSPECTION REP 3RT NOS. 50-327/92-36 AND 50-328/92-36)

This refers to *.he routine resident inspection conducted by W. Holland of this

office from November 29, 1992, to January 2, 1993. The inspection included a

review of activities authorized for your Sequoyah facility.

At the conclusion

of the inspection, the indings were discussed with those members of your

staff identified in the anclosed inspection report.

Areas examined during the inspection are identified in the report.

Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of the inspection, an apparent violation was identified

and is being considered for escalated enforcement action in accordance with

the " General Statement of Policy and Procedure for NRC Enforcement Actions"

(Enforcement Policy), 10 CFR Part 2, Appendix C, (1992).

The apparent

violation involved inadequate procedures and failure to follow procedures,

which resulted in the mispositioning of throttle valves. These problems

resulted in 3 lack of configuration control which potentially had a

significant effect on the ability of safety-related systems to perform their

intended safety function. Accordingly, no Notice of Violation is presently

being issued for these inspection findings.

Please be advised that the number

and characterization of the apparent violation described in the enclosed

inspection report may change as a result of further NRC review.

An enforcement conference to discuss this apparent violation has been

scheduled for January 26, 1993, in the NRC Region 11 Office.

The purposes of

this conference are to discuss the apparent violation, its cause and safety

significance; to provide you the opportunity to po' int out any errors in our

inspection report; to provide an opportunity for you to present your proposed

corrective actions; and to discuss any other information that will help us

determine the appropriate enforcement action in accordance with the

Enforcement Policy. You will be advised by separate correspondence of the

results of our de'iberations on this matter.

No response regarding the

apparent violation is required at this time.

In- additio'n,' based on the results of the inspection, certain of your -

activities appeared to violate NRC requirements as described in the enclosed

Notice of Violation (Notico). We are concerned about the violations because-

they: indicate a recurring problem at Sequoyah in the area of configuration

control of safety related equipment. The mispositioning of a diesel generator

fuel oil transfer pump handswitch, the mispositioning of a Refueling Water

,

' Storage Tank immersion _ heater handswitch, and mispositioned throttle valves

are examples of problems -in configuration' control which affected safety

related plant equipment.

In addition, an unresolved Item was also identified

in this inspection Report associated with potential problems in planning,

coordination, and configuration control of infrequently performed operational.

,

activities.

This issue is still being reviewed by the NRC.

Several problems

l:

in configuration control ef safety related equipment have also been documented

l

in previous Inspection Reports. Although the root causes of the above.

problems are in some cases varied, a recurring outcome appears to be the

inability of Sequoyah management to insure the proner alignment of safety

related equipment and maintain proper configuration during operationil

activities. The Sequoyah management staff has initiated long term corrective

actions to address these problems.

The result of these activities will be

carefully reviewed during future NRC inspections.

An additional activity which appeared to be-in violation of NRC requirements

as described in the enclosed Notice was associated with the failure to perform

inservice inspection (ISI) activities in accordance with lechnical-

Specifications. We are concerned about this violation because it reflects a -

lack of ownership with regard to the ISI pressure testing program.

Previous

programmatic weaknesses have been identified in your ISI program regarding.aL

lack of management direction and control,
