l ENCLOSURE 1 NOTICE OF VIOLATION Duke Power Company Docket Nos. 50-269, 50-270 and 50-287 Oconee License Nos. DPR-38, DPR-47 and DPR-55 The following violation was identified during an inspection conducted on April 22 - 26,1985. The Severity Level was assigned in accordance with the NRC Enforcenent Policy (10 CFR Part 2, Appendix C).

10 CFR 50.59(b) requires that the licensee shall maintain records of changes in the facility and of changes in procedures made pursuant to this section, to the extent that such changes constitute changes in the facility as described in the safety analysis report or constitute changes in procedures as described in the safety analysis report. These records shall include a written safety evaluation which provides the bases that the change does not involve an unreviewed safety question. The licensee shall furnish annually to the NRC a report containing a brief description of such changes including a sumary of the safety evaluation of each. Additionally, 10 CFR 50.71(e)(4) requires that the submittal changes made under the provision of 10 CFR 50.59 shall reflect all changes up to a maximum of 6 months prior to the date of filing.

Contrary to the above, the annual report for nuclear station modifications completed between January 1 and December 31, 1983 was submitted on March 7, 1985.

This is a Severity Level IV violation (Supplement I).

Pursuant to 10 CFR 2.201, you are required to submit to this office within 30 days of the date of this Notice, a written statement or explanation in reply, including: (1) admission or denial of the alleged violation; (2) the reasons for the violation if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be achieved.

Security or safeguards information should be submitted as an enclosure to facilitate withholding it from public disclosure as required by 10 CFR 2.790(d) or 10 CFR 73.21.
