Dear Judge Wolfe:

The Licensee noted in a footnote on page 30 of its Proposed Findings of Fact and Conclusions'of Law that on June 10, 1985, NRC advised the Licensee that it would not object if the Licensee were to begin construction work on the dry cask facility planned for the Surry Power Station. There have been additional develop-ments in connection with matters that were the subject of testi-many at the hearing. For example, on the evening of June 20, the Board of Supervisors of Surry County authorized the issuance of a conditional use permit for the construction of the Li-censee's dry cask storage facility. I am advised by the Licensee that work will begin on the facility momentarily. In addition, i testimony at the hearing indicated that DOE plans to begin re-ceiving Surry spent fuel at its Idaho test facility in early July 1985, pursuant to the Cooperative Agreement. Thus, still more new developments can be expected to occur between now and issuance of the Board's Initial Decision.

Customarily,_the Licensee's practice would be to advise the Board of such developments as they occur. On the other hand, I am sensitive to the fact that the record is closed in this proceeding and that the Board might prefer to reach its decision without regard to intervening developments. I would therefore appreciate it if the Board would inform the parties as to whether it wishes to be advised of intervening developments that are relevant to the subject matter of the proceeding or 8507010325 850626
