SECRETARY

' MEMORANDUM FOR:

William J. Dircks, Executive Director for Operations Herzel H. E. Plaine, General Counsel John E.

Zerbe, Director, O E

FROM:

Samuel J. Chilk,-Secreta [

SUBJECT:

EVALUATION OF PETITIONS COMMISSION In a letter to the Commission concerning a UC.S petition now under review, UCS stated. that, following a recent Commission meeting, an individual identifying himself to a'UCS representative as a " member of ' the NRC staff," indicated that

he would "probably be the one assigned-to shoot [the petition]

down."

The Commission believes that such remarks by any NRC employee are wholly inappropriate.

The Commission expects that petitions to the NRC will be fairly evaluated without prejudgment. _This Commission intent should be clearly conveyed to your staffs.
