Dear Mr. Devine:

This is in further response to your letter dated September 13, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), all documents connected with the June 12, 1984, Congressional Briefing on the Diablo Canyon Nuclear Power Plant.

A copy of the trar, script of a June 12, 1984, Commission meeting entitled

" Warmup for Chairman on Diablo Canyon" is being placed in the NRC Public Document Room (PDR). This record will be filed in PDR folder F01A-84-740 under your name. Portions of pages 10, 11, and 13 of this transcript are being withheld from public disclosure pursuant to Exemption (7) of the Government in the Sunshine Act (5 U.S.C.5552b(c)(7)) and 10 CFR 9.104(a)(7) of the Commission's regulations. Disclosure of this information would inter-fere with ongoing investigations.

Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. Ben B. Hayes, Director, Office of Investigations.

This denial may be appealed to the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."

The NRC has not completed its review of the remaining documents subject to your request. We will respond as soon as that review is completed.
