Company (Northern States), authorizing the. licensee to possess, use, and

operate the Monticello Nuclear Generating Unit No. 1, a single cycle, forced circulation, boiling water nuclear reactor (the reactor) on y Northern States' site in Wright and Sherburne Counties, Minnesota. A f

notice of issuance of a provisional operating license was published in i the Federal Register on September 15, 1970 (35 F.R. 14476).

The reactor is designed to operate at approximately 1670 megawatts f f

thermal, but initial operation was limited to five megawatts thermal and  ;

l without the reactor head in place to permit initial fuel loading and l e

testing. t Pursuant to the initial decision dated January 15, 1971, of the I Atomic Safety and Licensing Board (Board), the Commission has issued, )

- ef fective as of the date of issuat ce, Amendment No. 1 to Provisional- j Operating License No. DPR-22. The amendment supersedes the September 8, 1

= 1970, license in its entirety and authorizes Northern States to operate t

the reactor at power levels not to axceed 1670 megawatts thermal with the J-reactor vessel head in place; however, operation at power levels in excess _

of -five megawatts thermal with the reactor vessel head in place is subjecc to satisfactory demonstration of the operation of the plant feedwater pumps.

N The Commission's regulatory staff has inspected the facility and has J

• determined that , for operation as authorized by the amendment, the facility

• has been constructed in accordance with the application as amended, the I provisions of Provisional Construction Permit No. CPPR-31, the said initial 1

decision, the Atomic Energy Act of 1954, as amended, and the Commission's 3

regulations. The licensee had previously submitted proof of financial

)

protection and satisfaction of the requirements of 10 CFR Part 140. The Commission's regulatory staff will further inspect the facility to determine I

whether acceptable performance of the f eedwater pumps has been demonstrated.

Upon notification by the Commission in writing that such operation has d been so demonstrated, Northern States will be authorized to operate the reactor at power levels not to exceed 1670 megauatts thermal.
