Prange Nuclear Materials and Fuel Fabrication Branch Nuclear Regulatory Commission, Region V 1450 Maria Lane Walnut Creek, California 94596-5368 Dear Ms. Prange: This is in response to your request for additional information in your letter of September 30, 1992, mail control number 571563 (reference Enclosure 1 of this letter). Dr. Cronin has agreed to the conditions of availability and commitment stated in Enclosure 2 of this letter. Dr. Cronin is in an official volunteer status as a member of the research center staff. Dr. Cronin's status as volunteer does not change his authority or responsibilities in administering and managing the site radiation safety program. Dr. Cronin has unlimited access to the laboratory. The laboratory facility will be under the control of W. Spearman, Research Geneticist, and W. Seit::, Assistant Director, in Dr. Cronin's absence. ' If Dr. Cronin's availability changes or if any of our other commitments change, we will notify the Nuclear Regulatory Commission in writing with a license amendment request. Please note that we have not used radioact'ive material in the laboratory since March 1992. The radioactive waste that we have on-site has decayed and will be disposed of in accordance with our permit. We have no plans to use radioactive isotopes until March 1993, when our new geneticist, Dr. K. Scribner, comes on board. Statement of commitment and availability for performing RSO duties. f will conduct one on site inspection per week of the laboratory facilities licensed under NRC license number 50-29001-01, until my RSO duties are transferred to another qualified individual. I will report the results of weekly inspections to the director of the research center. I will be available for non-routine inspections, to address questions and operational issues, and for emergencies when I am in Anchorage. When I am out of town I can be contacted by telephone. I am currently the radiation safety officer for this license. I am leaving the Fish and Wildlife Service for a job in the private sector, but I will remain in Anchorage. I sill be replaced at an unknown time, perhaps as soon as 6 months from now. It may be desirable to maintain the materials license, depending on the new person's preference for radioactive or nonradioactive molecular biology methods. We would like to maintain our current license and replace me with Dr. R. Wilmot as radiation safety officer until my replacement in hired. Dr. Wilmot has experience working with radioactive materials (see enclosure) and is familiar with the operations in the Fish and Wildlife Service lab. No new radioactive material will be obtained or work with any radioactive materials will be done in the time period from my leaving government service and my replacement being on scene. Only radioactive waste will be kept on the premisgs in accordance with ge license. This will be primarily P and a small amount of S All of this waste will be . decayed to the point where it can be disposed of by August 1992. I will be working for a contractor which has active genetics research contracts with this office, and thus will have frequent contact with Dr. Wilmot. Mr. W. Qualified persons may be authorized to act as a temporary RSO provided that the individual commits to a specific amount of time on-site during which he will be available to perform his duties as RSO and that he will be sufficiently available to respond to questions and operational issues on an as needed or emergency basis. The licensee must verify that the temporary RSO will have the authority to properly maintain and effectively manage the radiation safety program for the licensee and that in his absence, adequate control will be maintained of the facility. The licensee must agree to the above as a license commitment which will be amended if the conditions of time on-site, availability and control change from those described. The commitment of time and the level of authority necessary for a temporary Radiation Safety Officer to adequately maintain and manage a radiation safety prcgram must be determined and approved on a case-by-case basis by the licensing reviewer. Ilowever, the licensee should be aware that it is the responsibility of the licensee, through the RSO, to ensure that the radiation safety activities are performed in accordance with approved procedures and regulatory requirements; and that the use of a temporary RS0 does not in any way relieve the licensee of the responsibility of ensuring the safe use of byproduct naterial. 57M63 - . .. . .. .-.

A copy of License 50-29001-01 and a Request for Technical Assistance are also enclosed. The last inspection of this license was conducted on May 22, 1990. A clear 591 was issued as a result of the inspection. It was noted in the report that this license was a one-man operation.
