SUPPORTING STATEMENT FOR DOE /NRC FORM 740M CONCISE NOTE SUBMITTAL IN COMPUTER READABLE FORM (3150-0057)
Qsgription of the Inform _tLlon Collection Nkt is required to collect nuclear material transaction information for domestic safeguards use and make it available to the IAEA. DOE /NRC form 740M,
" Concise Note," is used to provide information concerning qualifying statements or exceptions to other data forms submitted. Only those facilities which have been notified by letter from NRC that they are subject to 10 CFR Part 75 and those licensees who import or export nuclear materials are affected. Facility Attachments or Transitional facility Attachments for such facilities may specify circumstances under which Concise Notes are required to be submitted to the IAEA as attachments to other reports. In addition, submission of this form is required of licensees who import or export special nuclear material. NRC is proposing a regulatory change to make it mandatory that the licensee submittal be in computer readable form.
A. Mjlitation Need for the Infora tion Collection.
In order for the United States to fulfill its responsibilities as a ,
participant in the US/!AEA Safeguards Agreement and satisfy its domestic safeguards responsibilities, it is necessary for licensees affected by 10 CFR Part 75 and related sections of Parts 40, 50, 70, and 150 to submit accounting reports. DOE /NRC Form 740M " Concise Note" is needed to inform the U.S. or the I AEA of any qualifying statement or exception to any of the data contained in any of the other reports required under the US/lAEA Safeguards Agreement. NRC is proposing a regulatory change to make it mandatory that the licensee submittal be in computer readable form. This will be less burden on the licensee because most have their material accounting already automated.
Submitting the computer readable form will be easier than completing the hard copy form. The notice of proposed rulemaking is enclosed.
Agency Use of Information.
NRC is required to collect nuclear material transaction information for domestic safe- guards use and.make it available to the IAEA. DOE /NRC form 740M is used to provide information concerning qualifying statements or exceptions to other reports submitted. The use of form 740M, together with NUREG/BR-0006 and NUREG/BR-0007, the instructions for completing the forms, -
and NMMSS D-24, instructions for computer data input, enables NRC to collect, retrieve, analyze as necessary, and submit the data to IAEA to fulfill its reporting responsibilities. Without these reports.In ADP format, NRC's ability to collect and provide this data would be severely limited. All licensees currently under IAEA safeguards have computer capability.

2 i Reduction in Burden Throuah Information Technology..
Licensees have had the option of submitting the required information on a f acsimile of the form or transmitting the information electronically. The NRC has initiated a rulemaking to amend its regulations to require the licensees using DOE /NRC forms 741, 741A, 740M, 742, and 742C to submit such reports =in computer readable form. When' implemented, this change will eliminate the NRC's need for the hard copy form and reduce the burden on licensees through the use of current information tecnnology.
Effort to Identify Duplication. t The Information Requirements Control Automated System (IRCAS) was searched to determine NRC duplication. No duplication was found.
Effort to Use Similar Information.
NRC and the Department of Energy jointly utilize the Nuclear Materials Management and Safeguards System (NMMSS) to process and store and subsequently retrieve the information contained on the forms. The licensee is able to-file one report to meet the requirements of both agencies. This minimizes the reporting burden on industry members required to provide nuclear material data to both agencies.
Effort to Reduce Small Business Burden.
Burden on licensees will vary with the size and types of licensed operation.
The burden on small businesses will represent approximately five percent of the total burden. Further reduction would not enabic the NRC to fulfill its-international or domestic responsibilities.
Consecuences of less Freouent Collection.
if the requested information is collected less frequently, the NRC would be unable to have current knowledge of locations of nuclear materials as is required.
Circumstances which Justify Variation from OMB Guidelines.
There is no variation from OMB guidelines.
Consultations Outside NRC.
The staff met and consulted with a group of typical licensees on June 23, 1992, in Altanta, Georgia. Clarification of plans to make mandatory computer readable reporting was completed.
Confidentiality of Information.
Information or the form may qualify as business or financial confidential under the Code of Tederal Regulations, Title 10, Section 2.790.

3 Justification for Sensitive Ouestions.
There are no sensitive questions.
Estimate of Burden Number and Tvoe of Respondents.
Only those facilities which have been notified by letter from NRC that they are subject to 10 CFR Part 75 and those licensees who import or export nuclear materials are affected. Facility Attachments or Transitional Facility Attachments for such facilities may specify circumstances under which Concise Notes are required to be submitted to the IAEA as attachments to other reports. In addition, submission of this report is required of licensees who import or export special nuclear material. Approximately 38 licensees will have to submit form 740M annually.
Method and Schedule for the Information Collection.
Guidance and instructions are provided to all affected licensees by NRC.
Reports are required as occasioned by occurrence of specified events, such as the receipt, transfer, or adjustment to inventory of licensed material.
Reports are collected on a continuing basis as_ transactions occur. The data is entered into the NMMSS as received. The information is not compiled and published. However, it is available to the public for inspection and copying.
Estimated Hours Rtquired to Respond to the Information Reouirement.
Thirty-eight respondents are expected to submit an average of 30 forms each, annually. A total of approximately 1,140 reports are expected to be submitted-annually. The average burden of preparation and submission of each report is expected to be reduced from one hour to 45 minutes. The total resulting burden for required submissions of the form by all licensees will be 855 hours0.0099 days <br />0.238 hours <br />0.00141 weeks <br />3.253275e-4 months <br /> (1140 reports /yr x 0.75 hrs / report).
Estimated Cost to Respond.
The annual cost to each respondent to comply with this requirement is estimated to be $2,768. The total annual cost to all affected licensees is estimated to be $105,165. Cost estimates are based on a rate of $123 per hour.
Source of Burden Data and Method of Estimatina Burden.
This data is based on informal consultations by the staff with a small number of typical licensees and on actual reports submitted by licensees during 1990.
Reason for Chance in Burden.
The estimated burden has been reduced because automation should result in an average burden reduction of 15 minutes per response.

This includes the cost of ADP, record holding, and clerical processing of all forms (D0E/NRC Forms 741, 741A, 740M, 742, 7420, and IAEA Form N-71). The cost suballocated to Form 740M is
