1 SUPPORTING STATEMENT FOR DOE /NRC FORM 741, 741A,

" NUCLEAR MATERIAL TRANSACTION REPORT,"

NUREG/BR-0006, AND NMMSS REPORT D-24 SUBMITTAL IN COMPUTER READABLE FORM (3150-0003)

Descriotion of the Information Collection.

DOE /NRC Form 741, " Nuclear Material Transaction Report" and its continuatter.

sheet, Form 741A, are used for the collection of information for each IAEA material balance area showing all changes in the inventory of nuclear material.

NRC is proposing a regulatory change to make it mandatory that the licensee submittal be in computer readable form.

This will be less of a burden on the licensees because most have their nuclear material accounting-already automated.

Submitting the computer readable form will be easier than completing the hard copy form. The notice of Proposed Rulemaking is enclosed.

Reports are required as_ occasioned by occurrence of specified events, such as the receipt, transfer, or adjustment to inventory of licensed material.

Reports are collected on a continuing basis as transactions occur.- The proposed change is intended to streamline the collection of nuclcar material transaction data and increase the accuracy of the reported information.

For those licensees who have not yet automated their material accounting, the NRC will distribute a diskette with appropriate formats and user prompts _for completing forms.

A.

Justification Need for the Information Collection.

In order for the United States to fulfill its responsibilities as a participant in the US/lAEA Safeguards Agreement and satisfy its domestic safeguards responsibilities, it is necessary for licensees affected by 10 CFR Part 75 and related sections of Parts 40, 50, 70, 74, and 150 to submit accounting reports. The accounting reports for each IAEA material balance area must include inventory change reports showing all-changes in the inventory of nuclear material.

NRC regulations (10 CFR 40.64, 50.71, 70.54, 74.15, 75.31, 75.34, 150.16, and 150.17) require NRC and Agreement State licensees to make certain inventory and accounting reports for reporting any special nuclear material (SNM) or source material inventory changes that meet _certain criteria; for each transfer and receipt of SNM of one gram or more of contained uranium-235, uranium-233, or plutonium, or any combination thereof; or one kilogram or more of-foreign origin source material (depleted uranium, natural uranium, or thorium).

DOE /NRC Form 741, " Nuclear Material Transaction Report" and its continuation sheet, Form 741A, are used for the collection of this information.

NRC and the Department of Energy (D0E)-jointly utilize a Nuclear Materials Management'

2 and Safeguards System (NMMSS). Common reporting forms are used to minimize the reporting burden on industry members required to provide regulations or contractual obligations.

The licensee is thus able to file one report to meet the requirements of both agencies. Compliance with specific reporting i

requirements is monitored by the agency for which the specific data is required. DOE contractors currently submit data using the DOE automated SACNET. This proposed change to computer readable form for licensees will make all input to NMMSS machine processable.

Aaency Use of [nformation.

nRC is required to collect nuclear material transaction information for domestic safeguards use and make it available to the IAEA. The use of the computer readable submittal, together with NUREG/BR-0006, the instructions for completing the forms, and NMMSS D-24, instructions for computer data input, i

enables NRC to collect, retrieve, analyze as necessary, and submit the data to IAEA to fulfill its reporting responsibilities. Without these report forms, in ADP format, NRC's ability to collect and provide this data would be severely limited.

Reduction in Burden Throuah Information Technoloav.

Licensees have had the option of submitting the required information-on a facsimile of the form or transmitting the information electronically.

The NRC has initiated a rulemaking to amend its regulations to require those licensees using DOE /NRC Form 741, 741A, 740M, 742, and 742C to submit such reports in computer readable form. When implemented, this change will eliminate the NRC's need for these hard copy forms and reduce the burden on licensees through the use of current information technology.

Effort to identify Duplication.

The Information Requirements Control Automated System (IRCAS) was searched to determine NRC duplication. There-is a small amount of duplication in that, upon termination of licensed operations by a licensee,' NRC requires the licensee to file NRC Form 314, reporting the transfer or other disposition of any remaining licensed radioactive material, and the date of transfer.

This small duplication imposes a minimal _ burden on licensees, and is necessary to maintain accountability of licensed material in NMMSS and to permit NRC to make a determination whether the facility has been cleared of radioactive material and is suitable for release for unrestricted use or whether additional decontamination measures may be required.

Effort to Use Similar Information.

NRC and the Department of Energy-jointly utilize the Nuclear Materials Management and Safeguards System (NMMSS) to process and store and subsequently retrieve the information contained on the report.

The licensee is able to file one report to meet the requirements of both agencies.

This minimizes the reporting burden on industry. members required to provide nuclear material data to both agencies.

3 Effort to RedVce Small Business Burden.

Burden on licensees will vary with the size and types of licensed operation.

The burden on small businesses will represent approximately five percent of the total burden.

Further reduction would not enable the NRC to fulfill its international or domestic responsibilities.

Consequences of less freauent Collection, if the requested information is collected less frequently, the NRC would be unable to have current knowledge of locations of nuclear materials as is

required, Elrcumstances Which Justify Variation from OMB Guidelines There is no variation from OMB guidelines.

Consultations Outside NRC.

The staff has met and consulted with a group of typical licensees on June 23, 1992.

Clarification of plans to make mandatory computer readable reporting was completed.

Confidentiality of Information.

Information on the report that respondents indicate is business or financial confidential may qualify for protection from disclosure under 10 CFR s2.790.

Sensitive Questions.

Estimate of Cost to the federal Govg.rnment.

The collection of information requires an average of 5 minutes of HRC staff time per form.

This includes the cost of ADP, record holding, and clerical processing of all forms (DOE /NRC forms 741, 741A, 740M, 742, 742C, and 1AEA form N-71).

The cost suballocated to forms 741 and 741A is $900,819.

Estimate of Burden Estimated Hours Reauired to Respond to the Information Reauirement.

TFis reporting requirement affects approximately 1,200 persons licensed by the NkC or an Agreement State to possess source or special nuclear material at certain ty)es of facilities, br at any location in amounts greater than one effective (ilogram. This excludes 300 inactive licenses.

The average burden for preparation and submission of each report is expected to be reduced from one hour to 45 minutes.

The number of reports submitted annually will vary with the size and type of licensed operation.

Large licensees with complete operations may submit 1,000 forms annually.

Small licensees may submit 50 forms annually. A total of approximately 20,000 reports are expected to be submitted annually.

Thus, the total resulting burden for all licensees will be 15,000 hours0 days <br />0 hours <br />0 weeks <br />0 months <br /> (20,000 x 0.75 hrs).

Estimated Cost to Pescond.

The average annual cost to each respondent to comply with this requirement is estimated to be $1,538 (15,000 hrs / 1200 licensees x $123/hr).

The total annual cost to all affected licensees is estimated to be $1,845,000. Cost estimates are based on a rate of $123 per hour.

Source of Burden Data and Method of Estimatina_ Burden.

This data is based on informal consultations by the staff with a small number of typical licensees and on actual reports submitted by licensees during CY 1990.

Reasons for Chanae in Burden.

The estimated burden has been reduced because automation should result in an

- average burden reduction of 15 minutes per response.
