Dear Congresswoman Slaughter:
I am responding to your letter of December 22, 1992, to Dennis K. Rathbun, Director, Office of Congressional Affairs, concerning a request for assistance by a constituent, Mr. Edward S. Wollesen, who alleges error in a decision issued in a Department of Labor proceeding conducted pursuant to Section 210(a) (changed to Section 211 by the EqerQv Policy Act of 1992) of the Enerav Reoraanization Act of 1974, 42 U.S.C. 5 5851.
Mr. Wollesen's request for assistance concerns the evidentiary record of a Department of Labor proceeding, not a U.S. Nuclear Regulatory Commission (NRC) proceeding.
Accordingly, we suggest that his request for assistance be directed to the Department of Labor.
The NRC evaluated the safety-related issues associated with Mr. Wollesen's complaint before the Department of Labor and found that they do not present a substantial safety concern and do not warrant any enforcement action.
The evaluation of the safety-related issues raised by Mr. Wollesen is contained in the Director's Decision under 10 CFR 6 2.206 dated November 3, 1991, a copy of which is enclosed for your information.
