This refers to your rtent telephone conversation, requesting an exemption frm the requirement of 10 CFR Part 70.23(a)(7) for the approval to commence construction of a uranium recovery facility prior to completion of the envi romental assessment. From the infomation provided in your March 20, 1985 application, we find that construction alone of a uranium recovery facility at an al ready cmmitted industrial site does not constitute a major Federal action significantly affecting the quality of human enviroment. However, the possession and use of special nuclear material in this f acility, as you have proposed, requires an enviromental assessment pursuant to 10 CFR Part 51.
The enviramental assessment will not only cover the inpact of your proposed action, it will also include the cumul ative impact from your fuel f abrication operati ons.
In this connection, the NRC staff will have to assess the significance of potential enviromental impect to detemine whether the provisions of 10 CFR Part 70.23(a)(7) are or should be applicehle to your proposed action.
Our staf f will do everything we can to complete the enviromental assessnent i n a timely manner.
In the meantime, if you wish to start construction of the facility prior to the completion of the enviromental assessment, it will be at your own risk.
