Subject: Combined Inspection Number 50-245/85-11; 50-336/85-14

A special safety inspection of your transportation program was conducted by

Dr. M. Shanbaky of this office on April 15-19, 1985, at Millstone Point Nuclear

Power Station, Waterford, Connecticut and your corporate office at Berlin,

Connecticut, of activities authorized by NRC License No. DPR-21 and DPR-65.

Discussions of our findings were held by Dr. Shanbaky with Mr. E. J. Mroczka

of your staff at the conclusion of the inspection.

In addition, an inspection was conducted by a representative of the State of

South Carolina on March 11, 1985, of a shipment of radioactive waste from

Millstone Point Nuclear Power Station. That inspection report was previously

i sent to you attached to NRC Region I Inspection Report No. 50-245/85-09 and

50-336/85-11 and was discussed with you at the Enforcement Conference held at

our office in King of Prussia, Pennsylvania on March 25, 1985.

Areas examined during the special safety inspection are described in the NRC

Region I Inspection Report which is enclosed with this letter. Within these

, areas, the inspection consisted of selective examinations of procedures and

representative records, interviews with personnel and observations by the

inspector.

Based on the results of these inspections, it appears that two of your

activities were not conducted in full compliance with NRC requirements, as set

forth in the Notices of Violation, enclosed herewith as Appendices A and B.

The violations have been categorized by severity level in accordance with the

NRC Enforcement Policy (10 CFR 2, Appendix C) published in the Federal

'-

Register Notice (49 FR 8583) dated March 8, 1984. You are required to respond

to this letter and in preparing your response, you should follow the

instructions in Appendices A and B.

Regarding Appendix A, the violation for which you have been cited has already

been the. subject of enforcement action by the State of South Carolina. On

. March 12, 1985, the State of South Carolina assessed a civil penalty of $5,000.

In addition, the State of South Carolina suspended your burial site

privileges.

In view of the circumstances surrounding this matter, including the

!

enforcement actions taken by the State of South Carolina and your timely

and aggressive corrective action, we have exercised our discretion under

the NRC Enforcement Policy and have chosen to issue at this time the

enclosed Notice of Violation enclosed as Appendix A. This violation was

also previously discussed in Combined Inspection Report Nos.

50-245/85-09; 50-336/85-11. This report was sent to you on March 25,

1985.

Regarding Appendix B, the violation was noted during the special safety

inspection conducted on April 15-19,1985 (Combined Inspection Number

50-245/85-11; 50-336/85-14). The inspection report is enclosed with

this letter.

The special safety inspection conducted on April 15-19, 1985 focused on

the effectiveness of your packaging and shipping operations and manage-

ment controls. The inspection team identified a number of deficiencies

in your radioactive waste handling and shipping program and have charac-

terized these items as weaknesses in Appendix C to this letter. You are

requested to respond to Appendix C within thirty (30) days of the

receipt of this letter, stating actions taken, or planned, to improve

the apparent weaknesses therein.
