Dear Licensing Board Members:
We enclose Staff. testimony in connection with the evidentiary hearing scheduled to begin on Tuesday, July 7, 1981.
As discussed in conference calls with the Licensing Board and the
(-
parties, contention 1(d) and 2(b) are not addressed. Also, although the supplemental items to contention 2 are addressed in the filed testimony, witnesses will not present testimony on these items at the first two week session of the evidentiary hearing.
The NRC Staff and Consumers Power Company are filing with this testi-mony a proposed stipulation regarding the allegation of a breakdown in quality assurance prior to December 6, 1979.
If that stipulation is accepted by the Licensing Board as resolving the issue addressed, the NRC Staff will not offer the four items of testimony by (1) Eugene J. Gallagher, (2) James G. Keppler, (3) Joseph D. Kane and (4) Darl S. Hood -- all concerning quality assurance implementation prior to December 6, 1979.
It may be necessary, however, for the Staff to offer these four items of testimony in connection with contention 3(a). That decision will depend on the manner in which the parties address contention 3.
