BACKGROUND INFORMATION I
Section 50.72 of Title 10 of the Code of Federal Regulations was recently revised and became effective January 1,1984. A new Section 50.73 of Title 10 of the Code of the Federal Regulations has also been added and it also became effective January 1, 1984. Section 50.72 l
revises the immediate notification requirements for operating nuclear power reactors. The new Section 50.73 provides for a revised Licensee Event Report (LER) System.
Since paragraph (g) of Section 50.73 specifically states that: "The requirements contained in this section replace all existing requirements for licensees to report ' Reportable Occurrences' as defined in individual plant Technical Specifications," licensees were advised that the reporting requirements incorporated into the " Administrative Controls" section of their facility's Technical Specifications (TSs) may require modification (Generic Letter 83-43 (GL 83-43), " Reporting Requirements of 10 CFR Part 50, Sections 50.72 and 50.73 and Standard Technical Specifications, December 19,1983). Model Technical Specifications (MTS) addressing the required changes were provided with the December 19, 1983, letter to assist the licensees in preparing TS amendment applications.
The licensee's letter of January 4,1985, responds to the above Generic Letter.

. Evaluation The licensee's application specifically requested the following TS changes to reflect revisions of Section 50.72 and the addition of Section 50.73 to 10 CFR Part 50.

The licensee proposed the addition of the definition of Reportable Events to the Definition Section 1.0.
The proposed definition is in

accordance with the NRC staff's guidance in GL 83-43 and, therefore, we find this change is acceptable.
2.
The licensee proposed the revision of Section 6.5.2.7.g (Operation and Safety Review Committee Review) to read as follows: " Reportable Event Reports required by 10 CFR 50.73".
We have reviewed this proposed change and find that it is in accordance with the NRC staff's guidance in.GL 83-43 and, therefore, is acceptable.

The proposed revision to Section 6.6.1.a (Reportable Event Action) does not explicitly state that the submission of a written report is required (as suggested by the MTS), but it does require notification of the Comission pursuant to the requirements of 10 CFR 50.73. We conclude that this is an equivalent requirement and, therefore, is acceptable.

The proposed revisions to Section 6.6.1.b (Reportable Event Action) would specifically require that each Reportable Event be reviewed by the Plant Onsite Review Comittee (PORC), and these reports should be submitted to the Off-Site Review (OSR) Committee. We have reviewed these proposed revisions and have concluded that they are in accordance with the MTS and GL 83-43 and, therefore, are acceptable. Since the revised Section 6.6.1.b requires PORC review of Reportable Event Reports and in order to achieve consistency throughout the Peach Bottom TSs, the licensee has indicated to the NRC staff that Section 6.5.1.6 (PORC-Responsibilities) will be amended to clarify and reflect the requirements of Section 6.6.1.b.
This clarification amendment would be i
part of a forthcoming amendment application scheduled for sometime shortly after the approval of these TSs.

Section 6.9.2 (Reportable Occurrences) of the Peach Bottom TSs presently defines the events and conditions requiring submission of an LER.
Because 10 CFR 50.73 now provides the applicable definition of such events and conditions, the MTS suggest deleting this section of the facility TSs. The licensee has proposed the deletion of this section in accordance to MTS guidance. We have reviewed the licensee's proposed change and conclude that this deletion is in accordance with MTS and is, therefore, acceptable.

The proposed revision to Section 6.10.1.c (Record Retention) would read:
" Reportable Event Reports required by 10 CFR 50.73".
This change is responsive to the MTS and, therefore, is acceptable.

Environmental Consideration These amendments relate to changes in recordkeeping, reporting, or, administrative procedures or requirements. Accordingly, these amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of these amendments.
Conclusion We have concluded, based on the considerations discussed above, that:
(1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (2) such activities will be conducted in compliance with the Commission's regulations and the issuance of these amendments will not be inimical to the common defense and security or to the health and safety of the public.
