RVollmer BSnWer OELD TERA This is in response to your letter dated March 20, 1981, to Mr. Jo$8i"h kel ep gendrie, Chaiman, NRC, regarding the McGuire Nuclear Station.

The McGuire Nuclear Station Unit 1 was issued a Fuel Load and Zero Power License in January 1981. The next phase in the startup program fer full power operation is icw power testing and power ascension. The earliest licensee (Duke Power Company) schedule for this activity is July 1981 predicated on all required events including testing to occur without delay. Our review (issue of a final Supplecent to our Safety Evaluation Report) to support a full power operating license is expected to be completed in April 1981.

As you are aware, the public hearing before the Atomic Safety and Licensing Board ( ASLB) was recpened by the ASLB in response to a motion filed by the intervenor on the basis of new information resulting from the TMI accident.

The hearing was reopened in February 1981 and concluded in March. A decision by the ASLB is scheduled for September 1981. This will be followed by consideraticn cf the Atomic Safety and Licensing Appeal Board. Under present rules, the full Comission would then perfom its own review. A full power operating license is scheduled to be issued for McGuire Unit 1 in December 1981. The HRC is taking steps in hopes of improving these dates.

Upon issuance of our final Supplement to our Safety Evaluation Report (relating to a full power operating license), it is possible that t further motion to reopen can be filed on the basis of new infomation disclosed by the staff SER.

If such an additional hearing is required, the issuance of the full power license could be delayed.

The McGuire Nuclear Station, Unit 2 is projected to receive an operating license in 1982. The above process is not expected to impact the issuance of the Unit 2 operating license.
