Division of Systems Safety, NRR StJBJECT: ORAFT CONGRESSIONAL TESTIMONY REGARDING THE CHURCH ROCK TAILINGS IMPOUNDMENT FAILURE (TAC 5294,R-53)

A memorandum from R. E. Browning to rie dated September 26, 1979, asked for DSS technical assistance for preparing congressional testimony regarding the Church. Rock tailings impoundment failure. On September 27, 1979, in a meeting at NMSS offices, J. Kane of my staff obtained a copy of the following two documents from R. Scarano of the NMSS staff:

a) Letter to Chaiman Hendrie, from Morris K. Udall dated September 19, 1979.

b) Memorandum for Chaiman Hendrie, and Commissioners, from C. Kamerer, dated September 17, 1979.

A copy of each of these documents is attached (Enclosure 1).

Enclosure 2 is our draft testimony which addresses item 5 of the above letter from Morris Udall and item 4 of the above memorandum from C. Kammerer. This testimony was prepared by J. Kane, Geotechnical Engineer for inclusion into the overall response that is being prepared by R. Scarano. The other request items contained in Enclosure 1 are being addressed by NMSS as agreed upon with my staff at the September 27, 1979 meeting.
