Dear Sir:
Section IV.F of Appendix E to 10 CFR 50 requires that an emergency preparedness exercise be conducted (at least) annually.
The Authority conducted a FitzPatrick full-scale exercise on August 11, 1982 and a small-scale exercise on October 12, 1983.
In both cases, the Authority applied for and was granted schedular exemptions from the requirements of Section IV.F of Appendix E.

The first of these two exemptions (Reference 1) extended the deadline for completion of the initial exercise to September 1, 1982.
This exemption specified that the second annual exercise be conducted before April 1, 1983.
The second exemption (Reference 2) rescheduled the deadline for the completion of the second exercise to October 15, 1983.
This exemption did not specify a date for the third exercise.

o In a March 21, 1984 letter (Reference 3), the Authority requested an extension of the deadline for completion of the third annual FitzPatrick emergency preparedness exercise until August 31, 1984.
We further requested in our letter that this date be designated as the date to be used for the computation of all future exercises.
The Authority has reviewed our most recent exemption request.
After further discussion with our NRC Project Manager, we have decided to withdraw the request (Reference No. 3).
Using the month of August for the purpose of computing annual-exercise requirements is acceptable on the basis of being consistent with the guidance in IE Information Notice No. 82-44 (Reference 4) and meeting the schedular requirements of Section IV.F of Appendix-E.
Therefore, we concluded that a schedular exemption is not required.
