NRC Region i Resident inspection Report Nos. 50-317/92-27 and 50-318/92-27

(October 11,1992 - November 21,1992)

This report transmits the findings of the safety inspection conducted by the resident inspectors

at the Calvert Cliffs Nuclear Power Plant. At the conclusion of the inspection, these findings

were discussed with Mr. Cruse of your staff.

Areas examined during this inspection are described in the NRC Region I inspection Report

which is enclosed with this letter (Enclosur: 1) and were selected to ensure that your facility is

operated with due regard for the public heakh and safety. Within these areas, the inspection

consisted of selective examinations of procedures and representative records, int:rviews with

personnel, and observations by the inspectors. Overall, we have concluded that your facility was

operated safely.

Based on the results of this inspection, one apparent violation was identified and is being

considered for escalated enforement action in accordance with the " General Statement of Policy

and Procedure for NRC Enforcemeut Actions" (Enforcement Policy),10 CFR Part 2, Appendix

C (1992).

The apparent violation, discovered by BG&E personnel, was that the common

midaum flow recirculation line for all emergency core cooling system (ECCS) pumps was

iMated dunng part of the monthly surveillance testing

Under certain conditions, if a small

bre; A loss of coolant accident had occurred while the recirculation line was isolated, the pumps

could have been damaged unless prompt operator action was taken. The practice ofisolating the

recirculation line during surveillance testing had been in place since plant startup in 1974. No

Notice of Violation is presently being issued for these inspection findings. In addition, please

be advised that the number and characterization of apparent violations oescribed in the enclosed

inspection report may change as a result of further NRC review.

An enforcement conference to discuss this apparent violation has been scheduled for

January 7,1993. This enforcement conference will be open to public observation in accordance

with the Commission's trial program as discussed in the enclosed Federal Register notice

(Enclosure 2). The purposes of this conference are to discuss the apparent violation, its cause

and safety significance; to provide you the opportunity to point out any errors in our inspection

report; and to provide an opportunity for you to present your proposed corrective action. In

particular, we expect you to discuss why the plant licensed operators did not recognize the

consequences of isolating the ECCS pump minimum flow recirculation line; and what previous

opportunities you had to discover and correct this problem. In addition, this is an opportunity

for you to provide any information concerning your perspective on 1) the severity of the issue,

2) the factors that the NRC considers when it determines the amount of a civil penalty that may

be assessed in accordance with Section VI.B.2 of the Enforcement Policy, and 3) the possible

basis for exercising discretion in accordance with Section Vil of the Enforcement Policy. You

will be advised by separate correspondence of the results of our deliberations on this matter. No

response regarding the apparent violation is required at this time.

In accordance with 10 CFR 2.790 of the NRC's "!!ules of Practice," a copy of this letter and

its enclosures will be placed in the NRC Public Document Room.
