Dear Members of the Board:

At the prehearing conference on April 30, 1985, the Board provided CCANP with an opportunity to submit a brief on the question of whether the calling of an attorney for Applicants as a witness would prejudice CCANP.

As I notified the parties orally yesterday, after further research and discussion with Mr. Goldstein, CCANP decided it would not file said brief as there does not appear to be substantial prejudice to CCANP should Applicants' attorney be called.

This letter will confirm the oral notification provided yesterday.
