Dear Judge Wolfe:

The Licensee's principal witness on the subject of sabotage is Bob Jefferson,.who lives in Albuquerque, New Mexico. Mr.

Jefferson must teach a class in Albuquerque on the evening of Monday, May 20. He advises me that it will be mid- to late-afternoon on May 21 before he can arrive in Charlottesville.

i The Licensee's witnesses on the subjects of human error and the i dry cask alternative will be available at the beginning of the hearing and can remain as long as necessary. The Licensee pro-poses to put them on the stand before Mr. Jefferson appears.

It is conceivable, though perhaps unlikely, that these witnesses could complete their testimony and response to cross-examination l

prior.to 6:00 p.m. on May 21. If that were to happen, it is

.possible that Mr. Jefferson would either be in route or, if

( present, still out of breath.

I would appreciate it if the Board would consider this

! proposal: The Licensee will put on its direct case on human i error.and the dry cask storage alternative as soon as the morning I' limited appearances have been completed. After all of the ques-tioning of the Licensee's witnesses on those subjects has been L completed, we would adjourn the evidentiary portion of the hear-l ing until Wednesday morning, May 22, and Mr. Jefferson would take the stand at that time. Given the fact that we will recon-vene on Tuesday evening for limited appearances, this seems to j me a reasonable way.to proceed.

I have consulted with counsel for CCLC and counsel for the Staff.. Neither objects to this proposal,
