NUCLEAR PROJECT NO. 3 SAGINAW SPUR LAYDOWN AREA On February 16, 1977 the Supply System filed a motion with the Atomic Safety and Licensing Board for authorization to commence limited construction activities related to development and use of the subject laydown area for temporary storage of prepurchased equipment.
Also sought was a determination of "de minimis" environm60tal impacts.' elated to these activities.
In its Supplemental Partial Initial Decision dated May 10, 1977, the Licensing Board found that "the environmental impacts of the proposed construction and use of the Saginaw Spur are small and acceptable and that the impacts are s.
temporary and fully redressable". The Licensing Board's finding of de minimis was based, in part, on the provisions of the then existing Supply System lease to this area.
That lease provided that, at its termination, the Supply System would remove gravel, disc the area to turn any remaining gravel, and mulch and seed the area to facilitate its return to original conditions. The Licensing Board did not condition the limited work authorization upon restoration of the laydown area.

In view of subsequent changes in plans by the Supply System and the Landowner for the-laydown area, the Supply System is providing the NRC with the following updated information. The Supply System and Landowner have concluded a cash settlement regarding the termination of the lease for the Saginaw Spur area.
The amount of the cash settlement. was based on what the. Landowner represented it would cost him to restore the land to pasture. The Landowner now' has the' option of returning the land to pasture (using the cash from the -
settlement) or using the isnd in its present state.
As noted in the Supplemental Partial Initial Decision, the environmental impacts of the proposed use of the Saginaw Spur were considered "small and acceptable" and this finding is still valid should the Landowner decide to leave his land in its present condition.
This new information has been provided for informational purposes only.
The Supply System does not consider that further NRC action in this matter is necessary.
