May 8,1996 Niagara Mohawk Power Corporation is conducting an investigation regarding the implementatiori ofits Fitness for Duty program at Nine Mile Point. The results of this investigation will help Niagara Mohawk assess the effectiveness of our activities at Nine Mile Point and make improvements if necessary.
The investigation is being conducted by a task force comprised ofNiagara Mohawk personnel and Niagara Mohawk outside counsel. On behalf cfNiagara Mohawk, I request all persons contacted by the task force to cooperate with the investigation.
Based upon the information gathered from interviewees, documents, and other sources, a report will be made to Niagara Mohawk senior management concerning the issues under investigation.
Providing safe, reliable and efficient service to the public often requires a candid review of our operations. Your cooperation in this effort is greatly appreciated.

THE LICENSEE DISCOVERED THAT A SMALL NUMBER OF INDIVIDUALS HAD BEEN INVENTIONALLY REMOVED FROM THEIR FITNESS FOR DUTY RANDOM SELECTION POOL.
THIS WAS DETECTED DURING AN INVESTIGATION OF THEIR FITNESS FOR DUTY RANDDM i
SOF TWARE SELECTION PROCESS. IT APPEARS THAT TWO COMPUTER PROGRAMMERS SUBVERTED THE RANDOM SELECTION PROCESS, ONE OF WHICH HAD UNESCORTED ACCESS. MOST OF THE j
OTHER INDIVIDUALS REMOVED FROM THE RANDOM SELECTION POOL WERE UNAWARE OF THIS FACY AND APPEAR NOT TO HAVE BEEN INVOLVED. AS FOR THE INDIVIDUALS NOT INVOLVED. THE DETERRENT EFFECT OF RANDOM TESTING WAS NOT AFFECTED. THE j
INVESTIGATION IS CONTINUING. ONE OF THE INDIVIDUALS INVOLVED WAS. TESTED FOR CAUSE AND TESTED POSITIVE FOR DRUGS. THE LICENSEE HAS TERMINATED THE i
EMPLOYMENT OF ONE INDIVIDUAL AND SUSPENDED THE SECOND PENDING A FULL INVESTIGATION.

Attached Notice to Security Managers @ Nuclear Facilities The attached notice was sent to the Security Managers of all U.S. Nuclear facilities through the NEl Network for Security matters, as arranged today by Howard Christensen.
The wording and method of distribution is the result of direct communication with Rick Keimig of the NRC, Mark Wetterhahn, Denise Wolniak, and myself.
If necessary, further discussion with the NRC on the Task Force Charter, etc.,
will be held on Friday 5/10/96 prior to conduct of other business in King of Prussia on that date. I'll keep you all informed of any developments.
