. In Reference 1,-the NRC~ amended the requirements for leak testing of containment airlocks. The-Authority submitted an application #for amendment.to Section 4.7.A of Appendix A of the

. Operating License.via Reference 2.

In. Reference 2, the time'specified for testing the airlocks,

.In addition to the previously mentioned changes in this applica-tion, a seal test has been specified in lieu of the airlock test when: containment integrity is to be established following a period during which it was not required; and, no maintenance has been-performed on the airlock that could affect its sealing capability. Test pressure / leakage criteria for the seals have also'been specified. Appendix J to 10 CFR 50 requires a

. complete airlock test under the above conditions and the

' Authority hereby requests an exemption from this requirement in accordance with 10 CFR 50.12. -Justification for this exemption request is provided in Attachment II.

En accordance with 10 CFR 50.91, a copy of this application, with attachments, is being provided to the designated New York State official.

The Authority previously classified this Application for Amendment to the Operating License as Class III. A check in the amount of $4,000.00 was included with our earlier application (Reference 3) as the filing fee per 10 CPR 170.22, which the Authority had paid under protest pending a final determination of the legality of the fee schedule.

APPLICATION FOR AMENDMENT TO OPERATING LICENSE Pursuant to Section 50.90 of the regulations of the Nuclear Regulatory Commission (NRC), the New York Power Authority, as holder of Facility Operating License No. DPR-59, hereby applies for an Amendment:to the Technical Specifications contained in Appendix A of this license.

This proposed change to the James A. FitzPatrick Technical Specifications seeks to amend Section 4.7.A to the Operating License ,

relating to primary containment airlock test requirements. The proposed change is prompted by the Commission's amendment to 10 CFR 50, Appendix J, dated October 22, 1980, regarding leak testing of containment airlocks.

The proposed change to the Technical Specifications is presonted in Attachment I to this Application. The Safety Evaluation is included in Attachment II. The Authority seeks an exemption to 10 CPR 50 Appendix J, Paragraph III.D.2(b)(ii) and the justification for this exemption request is also provided in Attachment II.
