Paul Bollwerk, Esq., Dr. Peter Lam, and Dr. Charles Kelber Regarding Settlement With GPLN On August 14, the ASLB communicated to all parties involved in the August 2,1996 Prehearing Conference in the matter of Oyster Creek license amendment application. Because of difIiculties in contacting the attorneys for GPUN involving vacation schedules and out of towm work, Petitioners Nuclear Information and Resource Service (NIRS), Oyster Creek Nuclear Watch (OCNW), and Citizen Awareness Network (CAN), wish to communicate with the Atomic Safety and Licensing Board our interpretation of outcome of ti.e proposed settlement meeting with General Public Utility Nuclear (GPUN) as requested by The Honorable G. Paul Bollwerk, III, Esq..

It is the understanding of the Petitioners that ASLB requested that all the panies confer on whether an agreement could be reached before the Board considered the issues of standing and merit of contention to settle the dispute. Central to the negotiation is the reported safety analysis performed by GPUN to determine the risk associated with the shield plug drop onto a loaded Dq Shielded Cask.

The subsequent meeting to discuss a settlement was attended by Mr. Paul Gunter (NIRS),

Mr. Ernst Blake, Jr., Esq. (Shaw, Pittman, Potts, & Trowbridge) on behalf of the licensee, Ms. l l

Ann Hogdon, Esq. (NRC Office of General Counsel), and Mr. Ronald Eaton (Oyster Creek l Project Manager, NRC Nuclear Reactor Regulation). Mr. Blake informed Mr. Gunter that the GPUN safety analysis could not be made available to the Petitioners.

Therefore, with regard to a proposed settlement, the parties did not reach an agreement. )

Therefore, the Petitioners seek the Board's decision on standing and merit of their contention. )
