Dear Mr. Vassallo:

Generic Letter 84-09, which addresses recombiner capability requirements, was issued on May 8,1984. Carolina Power & Light Company (CP&L) responded to that letter, as it applied to the Brunswick Station, in letters dated June 8,1984 and June 27,1984.

In a letter dated -January 15, 1985 you requested additional information which the Company provided in a letter dated March 1,1985. A conference call was then held on March 13,1935 between members of our respective staffs and it became clear that CP&L and the' NRC are interpreting the requirements of Generic Letter 84-09 differently. Your staff indicated that Generic Letter 84-09 does now, and has always, applied to both normal operation and post-accident conditions. In each of its submittals the Company has made it clear that we interpret criteria 2 and 3 of the letter to be.

relevant only to post-accident conditions.

As documented in your letter of March 26,1985, your staff has indicated a willingness to consider an alternate approach to meet the intent of Generic Letter 84-09 provided that CP&L_ submit an adequate basis. The Company committed to indicate what direction our response will take by April 26,'1985.

Carolina Power & Light Company believes that our proposed modification meets the l

intent of Generic Letter 84-09. In order to more clearly present our proposed solution to this issue CP&L requests that a meeting be scheduled with your staff to be held in mid to i

late May 1985 at Bethesda, Maryland. The Company will present information to support its determination that this system meets the intent of Generic Letter 84-09.
