Supplemental response to Notice of Violation dated January 7, 1985, NRC IE Inspection Report Number 50-461/84-43

Dear Mr. Keppler:

Paragraph 2 of the NRC Notice of Violation, dated January 7, 1985, states that the licensee failed to establish effective measures for the acceptance of vendor documentation. The Illinois Power Company response to the Notice of Violation is contained in Attachment B to letter U-10248, dated February 19, 1985. The documentary evidence cited by the NRC was re-reviewed, and the documents were determined to be in accordance with procurement documentation requirements. This letter provides supplemental information in support of the Illinois Power Company conclusions expressed in response U-10248.

During a subsequent visit, the NRC inspector discussed response U-10248 with licensee representatives. The following information is in response to the NRC inspector's_ questions.

1. What assurance is provided that required documentation is identified by the licensee and received from the vendor?

Design specifications establish the docuseptation requirements for the vendor. The required vendor documentation is subsequently listed on a Documentation Checklist, Baldwin Associates form JV-146. Documents received are then receipt inspected in accordance with the documentation checklist attached to the receiving inspection report. Further, vendor documents are reviewed by Baldwin Associates and Illinois Power Company in accordance with the Records Verification Program.

2. What is the basis for the licensee determination that the Yarway supplied Certificates of Conformance and the Brazing / Heat Treat Verification Report satisfy ASME Code requirements?

Illinois Power Company has confirmed that ASME Code,Section III requirements for certification are satisfied by the Yarway NPV-1 Data Report. In addition to ASME Code and Design Specification K-2866B requirements,.Yarway supplied supporting documentation in the form of Certificates of Conformance.

. The Brazing / Heat Treat Verification Report is not ASME Code required, but it is a design specification required document. Data supplied by the Report satisfies the ASME Code,Section III, Paragraph NA 4932 requirement'to provide a summary description of heat treat time and temperature. The fact that the Report is unsigned is not an ASME Code Violation. Further guidance is provided by ASME Code Interpretation III-1-78-68 concerning Certified Material Test Reports, in that the heat treatment data may be reported as part of a Certified Material Text Report.

Illinois Power Company is confident that acceptable vendor documentation is available to meet design specification and ASME Code requirements. I trust that this information addresses the concerns of the NRC inspector.
