Dear Mr. Denton:
By letter dated December 20, 1983, Duke Power Company (Duke) requested NRC approval for application of the " leak-before break" concept to Catawba Unit 2 to eliminate postulated breaks from the structural design basis.
In support of that request and in response to_ Generic Letter 84-04, on May ll, 1984, Duke Power Company requested a partial exemption from the requirements'of 10 CFR 50, Appendix A, General Design Criteria (GDC) 4.
As a result of recent meetings, it appears that the NRC Staff is now. prepared to

grant limited exemptions to GDC 4.
Since certain aspects of our previous requests go beyond the scope of the limited relief contemplated by the Staff, we would-like to modify our previous request as follows:
1.
As discussed in the December 20, 1983 letter, implementation of the leak-before-break concept would allow, inter alia, the elimination of the need to consider the effects of previously postulated primary loop breaks on the reactor. cavity and subcompartment pressurization. While we still consider this relief to be justified, such relief is no longer requested but will be pursued during rulemaking on GDC-4.

By letter dated May 11, 1984, Duke requested a partial exemption to GDC-4.
Granting of this exemption, as requested, would have been for the life of'the facility. With the NRC now pursuing a change to GDC-4 through the rulemaking process, the lifetime exemption may not be necessary. -Therefore it is requested that the previously requested partial exemption to GDC-4 be granted for the first two cycles of operation for Catawba Unit 2.
