Dear Mr. Totten:
This is in further response to your letter dated January 16, 1984, in which you requested, pursuant to the Freedom of Inf ormation Act, documents from the Institute of Nuclear Power Operations (INP0) and the NRC that describe, analyze, or evaluate INP0's role or procedures in reporting its information to the NRC.
The documents listed in the enclosed Appendices G through M, with the exception of the 19 documents noted on the appendices with asterisks, sre being made available in the NRC Public Document Room. Those records indicated with a single asterisk on the appendices are being withheld in their entirety. Those records indicated with a double asterisk are being withheld in part.
Except as noted below, these records are being withheld pursuant to Exemption (4) of the Freedom of Infonnation Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations for the same reasons set forth in Mr. Zack T. Pate's letter of May 31, 1984, a copy of which was previously furnished to you.
i A portion of document 60 of Appendix K,1983, and all of document 82 of Appendix K, 1983, are being withheld pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5) of the Comission's regulations.
These documents are internal memoranda containing advice, opinions, and recommendations of the staff regarding NRC policy issues.
Disclosure of the documents would tend to inhibit the open and frank exchange of ideas essential to the deliberative process.
Exemption (b)(5) shields from the mandatory disclosure records generated in the deliberative process that precedes most decisions of government agencies (Jordan v. United States Dept. of Justice, 591 F.2.d 753 (D.C. Cir.1978)).
Thus, the exemption protects not only comunications which are themselves deliberative in nature, but all communications which, if revealed, would expose to public view the deliberative process of an agency (Montrose Chemical Corp. of California v. Train, 491 F.2d 63 (D.D. Cir. 1974)).
