Pursuant to 10 CFR 50.55a(g)(5)(111), I am submitting the attached relief request-for N7C review and approval.

This request foc rcljef from ASME'tode requiraments involves the extension of the inservice inspection interval f+ar unit 1.

Currently, the insvervice inspection interval fo: unit 1 is scheduled to expire December 29, 1992.

NRC Approval of this submittal' prior ta December 29, 1992 is requested.

A similar request (90-02) was initially submitted November 19,-1990.

NRC approval ~for that request was provided oJanuary 30, 1992.-

Subsequent to NRC approval, unplanneo extended forced outages of McGuire Unit: 1 have occurred.

This has resulted in delaying.the start of the Unit 1 End-Of-Cycle 8 refueling outage from December 11, 1992 to March 29, 1993.

Accordingly, an additional extension of time to ccmplete:all of the remaining outage related hydrostatic

' testa is requested.

'In addition, the unit 1 inservice-inspection plans and the inservice testing program plans for the second interval are currently under. development.

Submittal of these plans for NRC review and approval is scheduled for October 1, 1992.

ATTACHMENT DUKE POWER COMPANY MCGUIRE NUCLEAR STATION UNIT 1 Request for Relief From, ASME Code Section XI Requirements Relief Request 92-02 I.

Component for Which Relief is Requested The systems and components for which relief is requested are those portionL of items identified in the McGuire inservice inspection program that have not been hydrostatically tested as required.

Please reference the McGuire Inservice Program and post-outage inservice reports for McGuire Unit 1.

Only about 10% of the outage related class C hydrostatic tests remain and approximately 50% of the class B remain.

II.

ASME Code Section XI Requirement That Has Been Determined To Be Impractical l

ASME Boiler and Pressure Vessel Section XI, B and PV, and IWA 2400, Section C.

i III. Basis for Requesting R9'ia' By letter dated November 19, 1930, as revised July 13, 1991 and October 2, 1991, Duke Power Requested Relief (90-02) from the provisions of subparagraph IWA-2400(c) to add four i

weeks to the ten year ISI-interval (plus the twelve month extension allowed by IWA-2400(c)).

This would ensure that McGuire Unit 1 could operate until the end-of-cycle 8 refueling outage, which was currently scheduled to begin December 11, 1992.

Approval of this request by the NRC was l

granted on January 30, 1992.

Within the Safety Evaluation i

Report (SER), the NRC staff concitded tha. an extension of the Code-allowed elcven year insersice inspection interval for an additional 28 des was acceptable and would not endanger life, property, or the common defense and security, and is otherwise in the public interest.

III. Basis for Requesting Helief (continued)

SubJequent t'o NRC granting approval to our relief request (90-02),.McGuire. Unit I has recently experienced extended unplanned forced outages.

As such, the schedule for the Unit 1 end-of-cycle 8; refueling outage has been revised to

. March'29, 1993.

Accordingly an additional extension of time beyond that was approved is requested.

As currently scheduled, the end-of-cycle 8 refueling outage would begin.well after tle extended ten-year inservice inspection interval expires.

To comply with the ASME Code would require unit 1 to be shutdown by December 29, 1992 in order to complete all of the remaining required hydrostatic tests.

This would result in another extended unplanned

-forced outage.In order to complete a few remaining hydrostatic tests.

Based on our evaluation of the results from the inservice inspections _ completed thus far, extending the McGuire Unit 1 inservice inspection interval for the purpose of completing these hydrostatic tests would

-not endanger the quality of operations nor affect the health and safety of the public.

Therefore, the burden of extending a normal refueling outage in order to complete the remain.ing hydrostatic testing outweighs the benefit of imposing the requirement.during the current scheduled inservice inspection interval.

.To avoid the need for additional relief requests to be submitted in tne event there are additional' extended unplanned forced outages, Duke-requests that the extension be approved based on the start of the end-of-cycle 8 refueling outage instead of an explicit calendar date.

If an. explicit calendar.date is necessary, than an extension of 120 days beyond-the currently approved end date for the first interval is requested.

Alternate Testing No alternate examinations are being proposed.

The required

examinations-will be performed.

The only change will be the
