20555 INDIANA MICHICAN POWER COMPANY'S COMMENTS ON PROPOSED RULE CHANGE TO 10CFR50 Attention!

Dear Mr. Chilk:

A proposed rule was published in the Federal Register on April 24, 1992.

The subject of the rule change was.10CFR50 and the receipt of byproduct and special nuclear material.

This letter transmits our comments on the proposed rule.

The Nuclear Regulatory Commission has proposed to amend its regulations to allow a reactor licensee to receive back byproduct and special nuclear material that had been sent offsite to be reduced in volume.

The proposed rule's background information also includes a statement that licensees presently lack the authority to receive their waste back from processors. Because it has long been our position that neither the existing regulations nor our operating licenses for the Donald C. Cook Nuclear Plant preclude receipt back of such material, we support the proposed rule to specifically allow such a practice.

Offsite waste processing is a valuable service to reactor licensees since it is economical, it allows use of the best available technology, and preserves both the environment and waste volume allocations. Wo encourage implementation of this proposed rule change as written.
