I As we discussed by telephone with you, we are returning the referenced oil spill questionnaire because no oil was released to state waters.
The event was erroneously reported as a spill, when an amount of lubricating oil between 25 and 45 gallons was j
spilled into the North Anna Power Station Circulating Water Bay i
from the failure of the Unit 1 Circulating Water Pump lubricating oil reservoir.
The Circulating Water Bay is a concrete structure l
which physically separates water in the bay from the nearest l
state waters (Lake Anna).
The only opening to Lake Anna is approximately 10 feet below the surface of the lake to allow lake water to flow into the circulating water system.
The oil was retained on the surface of the water in the Circulating Water Bay, where it was cleaned up the same day, with no possibility of reaching Lake Anna.
No oil was observed on the lake.

Dear Sir or Madam:
1 This office has received notification that you discharged oil or hazardous substances in quantities that may be harmful, in violation of Section 311(b) (3) of the Federal Water Pollution Control Act, 33 U.S.C.
5 1321(b) (3), from' a facility as referenced above.
Accordingly, the Environmental Protection Agency (EPA) would like to obtain additional information regarding this alleged incident.
Pursuant to Section 308(a).of the Act, 33 U.S.C.
5 1318(a),
you are hereby required to submit to EPA the information requested in this letter.
If you fail to properly respond to this request, you may be subject to the following penalties.
Pursuant to Section 309(g) of the Act, 33 U.S.C.
S :.319(g), any person who violates Section 308 of the Act is subject to administrative penalties.
Pursuant to Section 309(d) of the Act, 33 U.S.C.
$ 1319(d), any person who violates Section 308 of the Act is subject to a civil penalty of up to $25,000 per day of violation.
In addition, pursuant to Section 309(c) (1) of the Act, 33 U.S.C.
S 1319(c) (1), any person who negligently violates Section 308 of the Act may be punished by a fine of not less than
$2,500 nor more than $25,000 per day of violation, or by imprisonment for not more than 1 year, or by both.
