Extension Request

Dear Mr. Chilk:

On December 7,1984, Duke Power Company orally requested from the

. Secretary's Office an extension of the time?/ in which to file comments with

. the Commission pertaining to the immediate effectiveness of the Atomic Safety and Licensing Board's decision regarding full power operation in the captioned ,

proceeding. See 10 C.F.R. 5 2.764(f)(2). In view of the extensive appellate activity (both Appeal Board and Court) associated with this complex proceeding, coupled with the delay in time before the Commission was scheduled to hear the case, the parties.*._*./ to the proceeding supported an extension of time until 10 days before the Commission was to meet on the case (now tentatively scheduled for the week of January 14,1985).

  • / While the Licensing Board Decision in this regard was signed on November 27, 1984, it was postmarked on November 28, 1984. In that the intent of 10 C.F.R. 5 2.764(f) is to provide 10 days from the date that the decision is issued (i.e., sent) in which to file comments, Duke calculated the original deadline to be December 10, 1984.
  • */ The parties contacted included Mr. George Johnson (NRC Staff) and Mr. Bob Guild who stated that he was speaking for both Palmetto Alliance and CESG.

diately of the extension (which was accomplished) and the approval of the request be memoralized ir, a letter to the Secretary.
