Enclosed are executed protective agreements between CASE and Westinghouse, and CASE and ITT Grinnell.
These agreements concern certain materials considered proprietary by those com-panies which were provided to CASE in connection with' Applicants' motion for summary disposition regarding design quality By their own terms these agreements are " subject assurance.
to the approval" of the Licensing Board.
Accordingly, we request that the Board approve these agreements.
We suggest that the most appropriate means of accomplishing this would be for the Board to issue an order indicating its approval and directing that the agreements become effective in this proceeding.
In a telephone conference with Mrs. Ellis she indicated CASE was in agreement with this approach.
