By means of this letter I am transmitting to you a copy of a recent affidavit executed by Warren H.
- Owen, Executive Vice-President of the Engineering, Construction and Production Group which updates Applicants' schedule for full power open : ion at Catawba. This affidavit was attached to a filing made before Judgt Kelley's Board on September 12, 1984.
As the affidavit shows, Applicants' current schedule calls for
. achieving criticality and commencing low power (0-5%) testing on October 17, 1984, completing low power testing by November 1,
1984, and commencing 0-100% power testing on November 1,'1984.
Thus licensing authority authorizing operation beyond the 5% power level is needed by November 1, 1984. Resolution of emergency planning issues now pending before this Board is~necessary before that date to allow the NRC Staff to process and issue the license in a timely fashion.
We would also take this opportunity to call to the Board's attention a decision recently issued by the Appeal Board (Pacific Gas and Electric Company, Diablo Canyon Nuclear Power Plant, Units 1 and 2), ALAB-781, NRC (September 6, 1984).) which addresses issues now pending before 8409240331 840918 PDR ADOCK 05000413 Q
