UNITED STATES NUCLEAR REGULATORY COMMISSION TOLEDO EDISON COMPANY AND THE CLEVELAND ELECTRIC ILLUMINATING COMPANY COCKET NO. 50-346 NOTICE OF ENVIRONMENTAL ASSESSMENT AND FINAL FINDING OF NO SIGNIFICANT IMPACT l

The U.S. Nuclear Regulatory Commission (the Commission) is considering issuance of an exemption from certain requirements of Appendix R to 10 CFR 50 l

to Toledo Edison Company and The Cleveland Electric Illuminating Company (the licensees), for the Davis-Besse Nuclear Power Staticn, Unit No.1 l

located in Ottawa County, Ohio.

ENVIRONMENTAL ASSESSMENT Identification of Proposed Action: The exemption would relax certain requirements of Appendix R to 10 CFR 50 as follows:

a)

A requirement of Subsection !!I.G.2 to provide a complett 3-hour l

rated fire barrier for the separation of reubndant trains of i

equipment necessary for safe shutdown would be relaxed with respect to a fire door which is not UL rated and has not been tested.

Instead, an engineering evaluation of the fire door has been performed simulating the fire test requirements of NFPA 251. The evaluation demonstrates that the fire door provides a level of safety equivalent to the technical requirements of Section !!!.G of Appendix R.

The requirement of Subsection III.L.1 that alternative, or dedicated

shutdown capability be able to achieve cold shutdown conditions within 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> would be relaxed to pennit limiting the cooldown rate to 1.5F/ hour under natural circulation conditions. This would extend the time to reach cold shutdown to 193 hours0.00223 days <br />0.0536 hours <br />3.191138e-4 weeks <br />7.34365e-5 months <br /> when offsite power is not available.

When offsite power is available, cooldown could be accomplished within the 72-hour interval.

c)

The requirement of Section 111.0 that the lube oil collection system be capable of holding the entire lube oil system inventory would be relaxed. The lube oil collection system for each coolant loop can contain the oil inventory from one of the two reactor coolant pumps l

away from hot surfaces and flannable material, The exemption is responsive to the licensees' application for exemption dated September 30, 1983, as supplemented by letter dated December 30, 1983.

The Need for the Proposed Action: The proposed exemption is needed because l

the existing design features relating to these fire orotection items are the most practical method for meeting the intent of Appendix R to 10 CFR 50 and strict literal compliance would not enhance significantly fire protection capability at the facility.

Environmental impact of the Proposed Action:. The proposed exemption will provide a degree of fire protection equivalent to that required by Appendix R to 10 CFR 50 such that there is no increase in the risk from fires at the facility. The probability of fires is not increased and post-fire

3-7590-01 radiological risk is not greater than detemined previously and the proposed exemption does not affect otherwise plant radioactive effluents. Therefore.

the Comission concludes that there are no significant radiological environmental impacts associated with this exemption.

The proposed exemption involves design features located entirely within the restricted area as defined in 10 CFR 20.

It does not affect plant nonradioactive effluents and has no other environmental impact. Therefore, the Comission concludes that there are no significant nonradiological impacts associated with the proposed exemption.

Alternative Use of Resources: This action does not invoh e the use of resources not previously considered in the Final Environmental Statements (construction permit and operating license) for the Davis Besse Nuclear Power Station, Unit No.1.

Agencies and Persons Consulted: The Commission's staff reviewed the licensees' request. The staff did not consult other agencies or persons.

FINDING 0F N0 $1GNIFICANT IMPACT The Commission has determined not to prepare an environmental impact statement for the proposed action.

Based on the foregoing environmental assessment, we conclude that the proposed action will not have a significant effect on the quality of the human envirco ent.
