Gentlemen:
TV Electric has reviewed the NRC letter dated October 26, 1995, concerning the inspection conducted by Inspector Mr. B. Ernest during the period of October 2 through October 5. 1995. The Inspection Report and attached Notice of Violation were dated October 26, 1995.
The Notice of Violation describes a failure to adequately protect Safeguards Information.
Our response is attached.

RESTATEMENT OF THE NOTICE OF VIOLATION l
(50 445/95 23: 50-446/95 23) i 1
During an NRC inspection conducted October 2 through October 5, 1995, one i
violation of NRC requirements was identified.
In accordance with the
" General Statement of Policy.and Procedure for NRC Enforcement Actions."
(60 FR 34381; June 30. 1995), the violation is listed below-10 CFR 73.21 (d) (2) states that while Safeguards Information (SI) is unattended, it will be stored in a' locked security storage container.
Contrary to the above, on August 28, 1995, the safeguards safe in the Security Shift Commanders office in the Alternate Access Point building was left unsecured for approximately 1 hour1.157407e-5 days <br />2.777778e-4 hours <br />1.653439e-6 weeks <br />3.805e-7 months <br />.
The safe contained copies of the Physical Security Plan. Contingency Plan and safeguards procedures.

TV Electric accepts the violation. The requested information concerning the violation is provided as follows.

Reason for the Violation On August 28, 1995, the safeguards safe in the Security Shift i

Even though the NRC inspector noted that the office door was locked.
there were multiple security officers working within a few feet of the door, and the location of the office would preclude any unlikely j
compromise of the SI. TU Electric's management review concluded that i
Security personnel did not follow approved procedures regarding unattended safeguards material and that the event was an isolated incident rather than a programmatic issue.
2.
Corrective Steos Taken and Results Achieved Individuals involved in the incident were retrained the same day in the required steps.for controlling safeguards information material.
The protection of SI per 10CFR73.21 (d) (2) criteria is being performed.at this location as well as all other approved SI storage locations at CPSES.

'3, Corrective Steos Taken to Avoid Further Violation Upon completion of the current remodeling of the Alternate Access Point, the SI material stored'in the Security Shift Supervisors safe, will be removed and placed in Security Post 57 (final Access Control)~
which is a continuously manned security position.
Procedure, STA-308, " Protection of Unclassified Safeguards Information" will be revised to add further training.for Primary Designees to ensure the requirements for the protection of SI is followed for their respective department.
