Enclosure 1, Periodic Review of RG 1.101 Regulatory Guide Number: 1.101, Revision 5

Title:

Emergency Planning and Preparedness for Nuclear Power Reactors Office/division/branch: NSIR/DPR/POB Technical Lead: Charles M. Murray Staff Action Decided: Revise

1. What are the known technical or regulatory issues with the current version of the Regulatory Guide (RG)?

This document has not been updated to reflect newly revised guidance documents that have been issued and new guidance documents that have been developed since the previous revision to RG 1.101. While the staff has not identified any technical issues or safety concerns with RG 1.101, Revision 5, as a part of their continued review efforts and the RG is still valid, it is outdated and should be revised.

In addition, each of the previous revisions contains guidance on separate issues for emergency preparedness and response. Therefore, applicants and licensees must review and use all versions of RG 1.101, rather than just using the most recent version, as is the convention for all other NRC regulatory guides. The guidance should be consolidated into a single version of RG 1.101.

RG 1.101 endorses the guidance in Revision 1 of NUREG-0654/FEMA-REP-1, Revision 1, Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants. Revision 2 to NUREG-0654 was issued on December 23, 2019. The RG should be updated to endorse the latest revision of the NUREG.

(2) What is the impact on internal and external stakeholders of not updating the RG for the known issues, in terms of numbers of licensing and inspection activities over the next several years?

The RG would not provide sufficient information if it were the only guidance that is used for emergency planning and preparedness. However, the current practice of internal and external stakeholders is to refer to the information on the NRCs external web site at Regulations, Guidance, and Generic Communications for NRC guidance and other guidance that is endorsed by NRC and is applicable to emergency planning. There is some impact on internal and external stakeholders of not having all applicable information in a single document. The impact on existing licensees is small because current licensees have approved emergency plans and few changes are required. The impact on new applications for new reactor plants is greater, but there are no current applicants for a new plant that needs to submit a new emergency plan for approval by NRC.

Enclosure 1, Periodic Review of RG 1.101 (3) What is an estimate of the level of effort needed to address identified issues in terms of Full-Time Estimate (FTE) and contract dollars?

No contract dollars will be used. Approximately 0.5 FTE is estimated to be needed to develop the RG revision in the 2020 timeframe.

(4) Based on the answers to the questions above, what is the staff action for this RG (Reviewed with no issues identified, Reviewed with issues identified for future consideration, Revise, or Withdraw)?

Revise the RG as part of planned guidance development activities. This effort will involve a review of other regulatory products and guidance documents that are currently in use. Based upon this review, the information will either be incorporated into the RG, the regulatory product will be referenced or endorsed in the RG, or the regulatory product will be superseded with other documents. Enclosure 2 lists the regulatory products that would need to be reviewed as part of this effort. Note that there may be more regulatory products than those listed, which will be determined during this effort.

(5) Provide a conceptual plan and timeframe to address the issues identified during the review.

It is anticipated that the revision to the guidance document will be provided to the NRCs Regulatory Guidance and Generic Issues Branch by December 31, 2020. It is anticipated that it will be issued for public review and comment by the second quarter of 2021.

NOTE: This review was conducted in April 2020 and reflects the staffs plans as of that date. These plans are tentative and subject to change.
